Everyone understands the virtue of a heresay...he said/she said case....BUT...that doesn't excuse the "accidental" leaks, web postings and other "mistakes" by the court. Not only should she file this civil case against Kobe...she should sue the Eagle County courthouse and the every employee responsible for its "mistakes".
Let me put my two cents in. The semen from the other two guys isnt important because it shows she had sex days after the rape, so therfore she was a slut. It matters because those injuries she claims were caused by Kobe could have been caused by the other guy or guys. It also matters because she interviewed saying that she didnt have sex w/ anyone else after the rape. So if its true other semen showed up, then it hurts her credibility.
The key here is Reasonable Doubt and nothing less. All of this evidence just helps build the doubt that he raped her. Thats why the prosecution is going to drop the case most likely on Tuesday after the final pretrial hearing and after the judge denies another motion from the prosecution, this time the one for a continuance.
Another thing they teach you on the first day in law school is that in a case like this you always try to win the criminal case first before the civil case because the criminal standard is much higher, therefore guaranteeing you victory in the civil case. Honestly, I dont think she has a chance in hell to win the civil case w/ all this evidence against her.
Bottom line is Kobe will settle give her a couple of milion and this will go away .Comment

Letter to Judge Ruckriegle
My wife and I have sat in your courtroom for months now and have patiently and politely refrained from saying anything to you about what we have observed. However, your most recent behavior is so harmful to us that I can no longer remain silent.
Over the past year I have watched you in the courtroom in disbelief. From the outset, it has been painfully obvious that you treat the defense as if they can do no wrong and the prosecution and my daughter's attorney as if you have something against them or this case. Your inappropriate and continual jokes with Mr. Haddon on a matter so personal and traumatic to my family are insulting. At the same time, you seem to take every opportunity to publicly criticize the prosecution and my daughter's lawyer.
I sat quietly frustrated as we saw Kobe Bryant and his lawyers hold a national press conference to profess his alleged innocence. I have watched as leak after harmful leak has gone unpunished. I have watched the defense attorneys manipulate the public opinion of my daughter with their pleadings on your website while you did nothing.
One of the most recent mistakes regarding the transcript of the defendant's paid expert has been devastating to my daughter and my family. I don't know if you understand the harm your staff has caused. I was extremely disappointed that you ruled against Mr. Clune's motion to discontinue the electronic distribution of court documents and the prosecution's motion requesting delayed posting of court documents. One of these safeguards should have been put in place. You cannot guarantee that there will not be further errors.
Recently, my daughter's attorney has tried to minimize the harmful impact of your mistakes by speaking out on television for the first time. Your latest order prohibiting anyone from speaking out to help my daughter tells me that you wish to see the harmful effects of the court's errors continue. My family and I have lost trust that we can obtain a fair trial in your court.
Someday my daughter will be able to stop being the "alleged victim" as you say and rebuild her life. While you move on to your other cases, I only hope that you can someday realize the devastating impact your decisions in this case have had on victims and victim's rights across the nation.
Respectfully,
Father of the victim
If you think he actually wrote that letter, you're fooling yourself. The prosecution can't go on tv and say their side of the story because of the gag order, so they'll send their subtle messages through letters like this one. It's a dirty tactic, just like those done by the defense. It works though, so kudos to them.Last edited by TallTell; 08-13-2004, 06:24 PM.Comment

Sex before Kobe gives a possible explanation. And the sex after Kobe helps that explanation.
One might say,
"Why would she willingly have sex with Kobe when she's already torn up from a previous guy? Wouldn't that hurt?"
You'd reply with another question.
"Why would she willingly have sex with another guy after Kobe tore her up? Wouldn't that hurt?"
See, if she had sex with someone before Kobe and after Kobe, the blood evidence is negated, because it shows her willingness to have sex with someone even though her womanhood may not be in top condition. Pretty sick if you think about it.Comment

Re: What a shocker
thank you tall tell. I was just about to state that. And she could like it rough. Dont know her but some girls like it rough and there can be a little blood involved. And if the guy is of above average in size it can come from initial penetration. Doesnt mean she didnt enjoy the rest.
no one can reall say that the are 100% convinced he did it based on the evidence and that is all that countsComment
