Long story short after KOing one of these guys the game (not the console, could hit the PS button to get to XMB) froze while saving. I lost my fighter from that space and I lost the two XP packs associated with him. I still have the athletic boosts, but the XP is gone and it didn't go back to the XP pack section. I tried to re-download, but you can't do that with XP packs.
I am going to try to get my money back or get my XP back, one or the other, but until then keep proof of your purchase. I have a feeling I am just going to end up royally screwed by what happened. At least I have proof of my purchase on the PS3.
Update - contacted devs and customer service, should here something soon.

You lose all of them points and it's is another way for EA to make money because you would want to do another boxer after this happening.
(Jazz) No. The XP you've purchased is yours-- you own it and we don't take it away. Once you remove your boxer, the XP is delivered to a bucket and can be used when creating another CAB through the Online World Championship or Online Gyms flows. If you import a CAB to either of these modes, you'll see this XP when you go to edit your CAB's Boxer Growth.
