    No, you the consumer do not hold this right.

    Software is sold as-is - often this is explicitly stated in the End User License Agreement for whatever software you buy - and it's the software company's prerogative as to whether or not to invest in deploying a patch.

    If the game literally did not function - as in, you click the Franchise mode option in the menu and the game crashes - then it's different and you begin to get into class-action lawsuit territory. As it stands now? There are minor bugs in the game which cause the game to not function as intended (but still function nevertheless), Tiburon is going to fix those bugs because they want their fans to enjoy all components of the game as they originally designed (and they are actively working on creating and deploying this fix), but you the consumer aren't explicitly owed anything beyond the game you have already bought and you agreed to this when you purchased the game.

      It's what was based on this thread. Even the guy creating it said he liked the game and a few others. All I was saying is that it's a good game that needs tweaks in the coming weeks. My interpretation of the forum was saying that "complaining" shouldn't be mixed up with intellectual critiquing and expectations. That's all I'm saying. Bad analogy or good analogy.

        I'm not trying to deviate this original discussion, but if a product is delivered broken there is an obligation on the developers and company to make the best product possible for their consumers. To say that the consumer isn't explicitly owed anything beyond game isn't fair in my opinion. (for instance, the debacle going on with rocksteady's game on pc this earlier summer). Feedback and forums are made for that exact reason. There is a responsibility on the company to own up to the expectation given( not just EA but all). And if this analogy is wrong then fine, but it's the same as saying that if a car is purchased off the lot then it's not the companies problem anymore because you purchased it. Not the case, because if so, there wouldn't be recalls. You don't drive off a lot and have the dealer say buy the car now, you've agreed to it and if we see fit or if we're generous enough we will patch the ABS,CD player and windshield wipers 3 weeks from now. No one is perfect, but there is nothing wrong with holding a high standard, while also providing a intellectual approach to that situation. To say a consumer has no right afterwards is saying that they have no voice. If there is displeasure with the product, that is shown in future purchases because you won't have return sales.

        And I have had good talks with EA personally(madden 07 and this one). Issues including uniform errors, stadium errors etc. (I'll admit I'm a freak with details). And called them directly instead of complain and etc.Actually this is the most active I've been in this in years. I talked to the developers and such about issues. And I'll also say that they are generally better about these types of things (such as streamlining help and Q&A) I'll hand that to them. Things have changed. My original post is simply saying that consumers shouldn't just have to praise and compliment. If done respectfully, there should be a chance to voice things that are found through the game that can make the experience better. That was my original interpretation of this thing. I just learned in life that being proactive most of the time helps more than just indirectly showing angst.

          Most of the stuff you posted I agree with you, except for that darn word "broken" again.

          I'm not sure, but it seems as if you didn't hear Rex's interview posted here. He owns up to the issues in CFM , apologizes and isn't happy about it.

          And the car analogy isn't a good one because you added there were recalls on the car. That's called buyer beware and the buyer should do all the research available to them to make said purchase, just like whether to wait and hold off until the patch for Madden.

          The game doesn't crash or freeze on my end, so, it is a working(ie not broken) game.

            If the game doesn't function to the point that the company themselves tell you not to play yet, like they have done with CFM, then that's pretty broken. You can still play it, and play other modes, but EA/Tib has told customers to NOT start a CFM. If this is true and consumers are waiting for CFM to be playable, then that seems broken to me. Can someone that has the game confirm this for me? Are CFMers waiting on a patch? Apologies if I'm wrong about this.

              Really what they should do is release a new Madden every two years instead of every year. In the off year, they can simply do a DLC roster/coaches update for like 19.95. I know I would pay it, they would still make money hand over fist, and have an extra year to work out all bugs in the upcoming release. That would also give them time to scrap an engine and create a new one, if they were ever so inclined.

                  He's talking about the people complaining about QB accuracy and defending the deep ball. It's happened more than once that a feature or gameplay was perfect for sim gameplay and the arcade crowd went ballistic and the game was changed to cater to them and ended up wrecking the game for sim style players.

                    Bucky, if you look into the slider forum, there are many people playing CFM as is. Take a look at Armour and Swords slider thread and the many other slider threads.

                    It's your choice to start a CFM or not. CFM does work as a functioning mode currently, there are some bugs that are preventing people from playing it, including myself.

                    Broken, to me, is I can't play the mode at all, it freezes or crashes on me.

                      The stockholders of EA would sell their stock if this ever happened, especially cutting the price of the game by more than 80%.

                      If you were the CEO of EA, would you tell your stockholder's that they are cutting the stockholders profits and dividends by 80% every other year?

                        Then we have different definitions of broken. When a company says "wait" for something to be fixed to start, that's broken enough to me.

                          Yep, agree to disagree here.

                          I don't see anyone in the slider forum saying they can't play and test CFM in it's current state.

                          Also, with the game only in our hands a week, I'm sure people are trying to be patient until the patch drops.

                            DLC costs awhole lot less to make than a full game. So 19.95 would almost be pure profit. Make it 29.95 pure profit. It is like the difference of a Kindle book compared to a hardback book. So the money would still be there.

                                You would have a difficult time selling that idea to stockholders.

                                I wouldn't even go near a roster update for 20 bucks for any game, let alone 30 bucks. If I wouldn't, there are many more that would follow suit.

                                Plus, you want them to scrap out a new engine and put a new one in. That takes time and money throughout the year as well. ie manpower, expenses, etc....

                                I'll go back to my original question.

                                If you were CEO of EA, would you tell your stockholders that every other year, prepare to lose out on more money than you are used to receiving with stock price and dividends.
