    For the first degree murder charge to stick, they would have to prove beyond a shadow of a doubt that it was premeditated.

    If he killed him in the heat of the moment, he's not guilty of first degree murder.

      Correction, Hernandez' contract has NONE of that language, Patriots have already paid him 9.5 of the 12 million from his extension, they are still on the hook for the remaining 2.5 million. he also has guaranteed salary, this season and next season that they will probably try to get back.

        It all sounds good and it should tie him but when these guys have $$$ and couple that with HIGH PROFILE attorneys it can at times make these type of cases a challenge for the courts

        Without going into detail about my Ex Uncle the evidence against him was OVERWHELMING!!! To this day we all know the truth but one slip up botched the whole thing.

        I can't wait to hear the angle that his defense will bring

          The real kicker is what if the casings don't match? What else was Hernandez or whoever else would have been shooting at while in the car?

            Speaking of dumb murderers, OJ literally left a trail of blood from the crime scene, into his SUV, his house and right up to his bedroom. If his name had been Joe Schmoe it would have been a slam dunk conviction. His Dream Team of lawyers knew they couldn't win based on the evidence so they cynically nullified the jury by successfully putting the LAPD on trial instead.

                It's going to be very hard for him to prove his innocents, unless someone else comes forward. I'll be shocked if he' will be. Either way his life is ruined.

                  I just can't agree with this until we hear his side. Nobody knows what the defense has to say and we probably won't for a while.

                      Never said he didn't have a chance just that It'll be very hard for him and his lawyer's to prove he is innocent, but with the amount of evidence piled up against him his lawyer's will have to have the trail of their career's. IMO as things stand right now I just don't see it happening.

                          Not really at all, if he is charged with Murder One, which is a capital offense bail is normally denied unless there is a lot of flimsy evidence, which doesn't seem to be the case here.

                            There is literally a (legal) mile from the shell casing match to he fired the fatal shot(s). There is no murder weapon yet, so there is no indication of the shots fired were at the crime scene, the shell casing was thrown away by the rental car cleaning company so it has been compromised already for prints and physical dna. I really want to know what/where the other two guys are and what they are charged with.

                            There is a mountain of evidence against Hernandez, but the legal system is crazy and gets crazier the better your attorney is.

                            Case in point. In the Trayvon Martin trial the audio from the encounter has been thrown out because both the prosecution and the defense claim the screaming was from both the victim and the accused and the audio experts couldn't determine who it was, so neither side gets to use it.

                            The prosecution has to put the gun in hernandez' hands at the time of the killing, and without the gun that is hard, and the defense could also play their ulitimate trump card, and have each of the three say that one of the other one was the shooter which is the ultimate reasonable doubt, a witness saying that someone pulled the trigger three times over.

                              Really, the fact that he was last seen with the victim at the time of death is enough I would think.


                              And the fact that he was upset with the victim too doesn't help much. Also the text to the victim sister about "I'm with the nfl so she knows.
