They don't. Drivers on the tail end of the lead lap when a caution comes out get the wave around which allows them to go around and catch up to the back of the field. free pass always goes to the first car 1 lap down or the first lapped car provided they weren't the cause of or involved in the incident that brought out the caution.Steelers : IX, X, XIII, XIV, XL, XLIII

The "Lucky Dog" rule IS for the first car that is 1 lap down. However, if they caused a yellow, they DO NOT get the "Lucky Dog."
The "Lucky Dog" rule does not apply during the last ten laps of the race.
Now what you are confusing is the "Lucky Dog" versus the "Wave Around Rule."
If the drivers on the tail end of the lead lap who are running just in front of the leader do not pit under caution, they are waved around to the end of the pack. They may then pit when the race goes green.Comment

sorry i was just asking because at darlington david gilliland was in front of kasey kahne who at the time was the leader and the fox announcers said that david would have got the free pass if he wasnt the caution but he was 30.09 seconds behind the leaderComment
