I got the game yeserday, and being a nut about frame rate, I was a bit concerned about some of the reviews. However, I want to say that it is not bad at all. Yes it is there on some tracks, and it is noticable, but it really doesn't affect the driving at all, at least for me I didn't.
Even as I approached the first turn in that first track they make you do, where many people have said it is the worst as far as FPS goes, it wasn't nearly as bad as I thought it was going to be. If any of you are concerned, rent it first. I'm usually anal about frame rate, but this game while not perfect is certainly playable.
Now if they can just get Pocono as downloadable content I'll be happy!
