Hopefully there can be a big civil suit verdict, unless Detroit as some law limiting what the city can be sued for. If the latter is the case, hopefully this ******** dispatcher has homeowner's insurance to give this family some means of recovery.

As for legal action, it would sound to me under the little Michigan law I know that the Dispatcher could be charged with manslaughter.

In theory if you can prove her life was shortened at all by the Dispatcher, whom had an affirmative duty to help then you could find her guilty. Selling this to a jury would be tough if not impossible however, but you could indict her to help with the families civil trial.

Seriously though, that just amazes me. Whoever said just dispatch emergency teams and then if its fake, press charges is right. No reason that couldn't have been the solution.

I disagree, and I am not trying to pull rank here but I am in Law School and serve as a Criminal Law clerk right now. I know it is a stretch, but I think you can meet the elements for the lowest degree of Manslaughter in Michigan, which has a low threshold.

It's so strange how underminded children are these days. This is one of the worst cases I've heard of in a long time... regardless if his mom was going to die before medics got there or not.

Vicarious liability. They can sue the operator's higher-ups for negligence as well.

Manslaughter is too much of a punishment. We don't know how many prank calls that lady got during the day, during her employment. Its no to excuse what she did. She still should be canned. & a huge lawsuit should be awarded as well, particularly since she has 10 kids.

As for why this is just making news, networks are more interested in a party girl's disappearance than what goes on w/a poor family in one of the worst cities in the country. Many would just call that thinning the gene pool.

Problem is a lot of Municipalities have laws limiting their liability, in MA it is limited to $100k. If the Operator has a home she could be worth more.

That's a tough situation. The operator probably gets a lot of prank calls each day and just assumed this was another. It's tragic that she guessed wrong in this case and it costs 10 kids their mother. Unbelievable.

In the very least, the operator has to lose his/her job. No other way around that. His/her judgment has to be in question enough after this incident to warrant termination.

A doctor would get sued for malpractice if he decided not to treat someone b/c he thought they were just playing around.
