    Well the legality of that would be in serious question. He at no point ever entered to an agreeement with CompUSA to purchase a second computer and as such owes them no duty to pay for it. Sure, they could try to argue that because he kept it he should pay for it, but that is countered by arguing that they sent it to him without his request and as such owes them nothing. As to what the law says about returning it, I doubt I know what the exact law in his state is, but I would be willing to bet this is CompUSA's problem, and not his.

      If CompUSA charged you twice for one computer, wouldn't you be up in arms about how CompUSA ripped you off? Well... now you're doing the same.

      If they discover the error before you contact them, you could be in for a rough time. They have the right to charge you if the box containing the PC is open, because they cannot resell it.

      If you contact them, the worst they can do is tell you to pay for its return.

        i ordered a pair of shoes on ebay once... the company sent me MY order and some other guys order.. my size and everything. I essentially had a free pair. the UPS sticker was the same tracking code for BOTH boxes. so there was no trace of his shoes... so i email them, let them know i have this guys order... The order slip was inside the box btw. They have me print out a return shipping slip and UPS came to myhouse to pick it up... a few days later, they send me a free shipping code good for 6-7 months on any purchases. i didnt expect or want a reward, but it came.

        i doubt a big company would do this for you but I'd fix one mans mistake in waiting for a return favor on a mistake of my own like someone here said
        Is it just me or is that whole post contradicting?

        I like the idea of donating to a needy family. It could really help them out, and you really don't NEED two computers that are exactly alike.

            Legally you can keep it. If someone sends you something in the mail that you did not request, you can keep it without paying anything for it.

            I once received a a order for someone else, some how they printed an extra shipping label and put it on the other person's box. I called to send it back and basicly it was a waste of my time. It took a long time to get to someone who could figure out what I was talking about and then to get the return packing label. Then they wouldn't even send a carrier out to pick it up. I wouldn't have returned it if the carrier wasn't on my normal driving route.

                This analogy is rather ubsurd don't you think? You would still have the crime of fraud to deal with there. As for the computer, the law is if you are sent something unsolicited in the mail you do not have to pay for it. This was a major scam some years back and the law evolved around it. Now there are obviously other arguments around this both ethically and legally, but IMO he doesn't need to compensate CompUSA for it. As for the ethics side, I'd highly suggest giving it to charity and not taking the applicable tax write off.

                  That makes no sense. If a company erroneously charges you for a product or service, there are policies and methods to have the ERROR corrected. A "rip-off" is a malicious and intentional attempt for favorable gain. First you imply that it is okay to keep it because they're "ripping" him off, then you say he's in deep $hit if he messes with it? On top of that, even if he didn't open the box and this is their error, he will now have to pay for the return on something he never asked for? You're talking out 3 sides of your butt bro!

                          That is where it gets dicey and would depend on the laws of the state he lives in. In all liklihood they have insurance to cover it and chalk it up as lost or stolen inventory. I'd imagine the cost to try and get any money from him legally would be more than the computer is worth to them.

                              How exactly am I contradicting myself? The company erroneously charging him is taking money from him. Him keeping a second computer he did not pay for is taking money from the company. Do tell how one is much less wrong than the other. There are also policies and procedures to have THIS error corrected.

                              I never implied that it's ok for him to keep it. You really should learn to read and comprehend.

                              He has an obligation to notify the company that he has their product, and yes, they can come after him for it if he refuses to return it.

                              I know for a fact that CompUSA will demand that he send the computer back at his cost. He can refuse and CompUSA will have to pay for it to be shipped back. If they refuse, he can keep it.
