Regardless of what the video contains, the fact is that he doesn't want his image associated with Kanye West. And I'm sure I could provide a litany of Kanye quotes and actions that would reveal himself as a non-role model for children. The content of the video is irrelevant.

The content of the video is very relevant. Its what he is basing his suit on. I dont agree with rockchisler that he is a racist though. I think he has been out of the spotlight and wants a check. The sad thing is he wont get one or if they settle it will be really small.

Well its to bad because Parodies have been around forever so for him to say I dont want to be associated with him..hey thats part of having a public lifestyle..Also Kanye has never said he was a role model for kids. And the Content of the Video Is Why This Thread Was Started

It's relevant from a legal standpoint, but I was speaking more in terms of why he doesn't want Kanye West using his image or likeness. It would be like if a convicted killer wrote a children's book from jail and it became popular. I wouldn't promote or want anything to do with it - not for its potential content, but because it was written by a killer.

An extreme example, I know, but it illustrates the point. Legally, he might not have a leg to stand on here. But I can understand where's coming from, that's all.

Weird Al would be fine, he gets permission do all of his stuff before he even does it. The Chamillionaire song he did, is even on Chamillionaire's own myspace page because he liked the version so much.

I was saying he had a problem with the Kiss, I didnt say Evel Knievel is a racist.

"According to the St. Petersburg Times, the suit was filed in U.S. District Court. In the suit, Knievel accuses West of illegally using his image and tainting it with vulgar, sexual and racially charged content."

But after reading this statement it does make me wonder.

Can we just agree that Knievel is just looking for a check. Kanye of all rappers out there is the least likely to be associated with violence and the bling era. If it was someone else in the rap game, you'd have a point.

Well legally speaking there is a doctrine in copyright law called the "fair use doctrine" (I think that is what it is called) under that theory a parody is automatically permissable, you don't need permission if you can in fact prove it was a parody. The leading case in this was the Luther Campbell suit when he used Pretty Woman, by Roy Orbison ( I still don't know what that judge was smoking to determine that the use was a Parody). I haven't seen this video, but I don't know if fair use extends to likeness and rights of publicity, based on what I have read, it looks like EK may get a settlement out of this.
