    Imus Fights Back!

    Well I guess this isn't too unpredictable but what makes this truly interesting is the language in Don Imus' contract. Here's excerpts from a CNN article:

    Imus had $40 million remaining on a multiyear contact that began in 2006 and included a clause that CBS wanted him to be "irreverent" and "controversial," according to CNN legal analyst Jeffrey Toobin, who was shown part of the contract.

    "Company (CBS Radio) acknowledges that Artist's (Imus') services to be rendered hereunder are of a unique, extraordinary, irreverent, intellectual, topical, controversial and personal character and that programs of the same general type and nature containing these components are desired by Company and are consistent with Company rules and policies."

    Toobin said the legal issues in the Imus case are simple: "Did Imus breach his contract by saying what he did about the Rutgers basketball team?".....

    "What stands out in the contract is he is supposed to be controversial and irreverent. That's what his statement about the Rutgers basketball team was," Toobin said.

    "How is CBS going to argue that what he said was so controversial and so offensive that it isn't what they asked for in the contract?"

    The contract does provide that CBS Radio may terminate the agreement for "just cause."

    According to the document, this includes "on-air mention whatsoever by Artist (Imus) of company's officers or directors. Such limitation shall not preclude references to members of station management, so long as such references are not overtly inflammatory or malicious."
    First of all, If I were in the radio business i'd love to find the guy who negotiated that contract for Imus because it's almost bullet proof. Imus has hired one of the top lawyers in America for this and while he hasn't filed suit yet it's pretty clear there's going to be a big settlement.

      Wow, I can't believe they wouldn't define some of those key terms in the contract, like exactly what it meant to be "controversial and irreverent" or what "just cause" was for termination of the contract. Seriously, I could go find a hundred or so first year law students who would realize how stupid that is, much less say who ever negotiated that contract.

      Overall it seems favorable to Imus, but the lack of definition would be troublesome for me. I am sure this gets settled out of court, and if not this will be in all sorts of Contracts Textbooks within weeks of the final adjudication.

          Irreverant seems pretty well defined.

            You'd think so, but in Contracts world words don't always take on their Webster's Dictionary meaning.

              As long as the I-Man returns to terrestrial or satellite radio soon, I could care less about this suit. My mornings are pretty dull without him.

              On second thought, I hope CBS gets mauled in this lawsuit as justice for being so gutless regarding Imus' firing.

                      Not sure if you are being sarcastic or not, since his comments were directed towards your Rutgers ladies.

                      However, I'll agree with your statement. I may not agree with what he says, but it is the radio, and no one is forced to listen to him talk. We have a thing called free speech, let the man use it.

                      Also, he is probably the ugliest man I have ever seen.

                            Agreed 100 percent, especially since CBS earned millions in ad revenue for the last two decades despite comments by Imus that were more offensive than the Rutgers' remarks.

                            Hypocrites. But ad money talks, as always.

                            All I can do as a pissed-off Imus listener is never watch MSNBC, browse MSNBC.com or listen to a CBS Radio Network broadcast again.
