    Is NewEgg headed for a major lawsuit?

    How is it that some obscure site is sending the game out in droves, while the major distributors are having to wait for the EA launch deadline?

    This could be business suicide.

    Newegg is far from obscure they are a large computer hardware site.

      Under what law would they sue? The businesses would have no standing to sue, only EA could do that. It's not an unfair business practice.

        even if they do (which they won't) newegg doesn't care. all of their revenue comes from computer hardware. if ea doesn't send anymore copies of madden to them in the future, it really won't matter.

          I also doubt anything will happen. Every year some walmarts sell early and you really think ea will say anything to walmart?

            First, NewEgg is not some obscure site.
            Second, except for you, the world does not revolve around Madden the video game. NewEgg is more worried about selling servers and computer hardware then a video game that they are making zero margin on.
            And lastly, GoGamer and NewEgg shipping the game out doesn't mean anyone will get it early.
            They probably will get it on Friday like everyone else.
            And in GoGamer's case, you will be lucky to get it in a week.

              Who cares. Street dates are BS anyway. The game is finished. It's been shipped. And it sits in the back room of the stores for 2 weeks. What the....is the point?


              I don't know if a lawsuit would even work. Printing "DO NOT SELL BEFORE DATE X" on the box it ships in isn't exactly legally binding, is it?

                EA could sue them to the value of their company. This is sort of like copyright infringement, but in a way that undermines an entire advertising and launch structure.

                  Since when is NewEgg obscure?

                  And Im pretty sure its because all the major game retailers are bound to stick to release dates. Mom and pop shops and various other distributors dont have to. Some choose to wait, some sell as soon as they get it. At least thats what Ive gathered.

                  And this happens with alot of games, not just Madden 10.

                  No lawsuits are coming.

                  Sounds to me like some people are just bitter that others are getting it early.

                      All EA can do is stop distributing to NewEgg which it is unlikely to do. There are no legal ramifications to breaking an embargo.

                          I really do not think EA cares. Someone posted on here that when they signed into Xbox Live with Madden 10.

                          There was a message like "Congrats on scoring an early copy of Madden"!!!!

                              street dates are only for big box retailers anyway. having street dates creates a fair market for the game, since no one is undercutting anyone with release.

                              i would guess that maybe 100 people will get it before friday from gogamer and newegg, so it's really a very small drop in the bucket of total sales.
