    That about sums it up.. I wish we had a system that would give the judge the power to make the person bringing up a lawsuit like this pay ALL legal fee's for both sides when dismissing a case.

      You know, "South Park: Bigger, Longer, and Uncut" wasn't that far off at the time and seems even more poignant right now. Just replace nakedness or sex with "bad language" (in this case animated sex) and it's the same story.

      When you buy a game rated MATURE (for ages 17+), you should expect the same things that can be seen in an R rated movie. Yes, that includes violence, sex, etc. You should be smarter than to just buy a mature rated game for a 14-year old kid and expect it to be Diddy Kong Racing (not a shot, it was a great game). I guess I'm preaching to the choir here though, since most people on this boards have something called common sense.

        yeah and I think it benefits the media more because people are blindly following along and boosting the ratings for this so-called news story. then the people make up their minds and follow what the leaders think is right, then it's all over

        I wonder if the 14 year old kid can get a voice in this. I bet he doesn't give a crap and won't be affected as much. I was playing mortal kombat at like age 9 or something and I am in no way a violent person. I guess different people are influenced in different ways.

          I also find it hilarious that she's suing on the behalf of other consumers. If she actually won the case, how many of those other consumers would see part of that loot.

          I wonder how the 14 year old grandson feels about this.

              My parents would not let me play Mortal Kombat until they thought I was mature enough to handle it.

                um, it's rated 17+, her grandson's 14, he shouldn't have been playing without her getting it for him...it's her fault IMO, this will be dismissed before trial I think, frivolous lawsuit

                    That's not a bad idea. It's sort of like a coach using a challenge in the NFL. If he loses the challenge, he loses a timeout. "You can go to court for these ridiculous reasons, but if you lose, YOU have to foot the bill." Sounds good to me.

                      That's actually a very good point. Legally, what is the difference between her giving a game intended for adults to a 14-year-old kid and giving him an alcoholic drink?

                        legally I believe the ESRB ratings are "recommended" and not like movies or alcohol where it's an enforced rule (Movie theaters ID for Rated R movies, and can get in trouble if they let lots of minors in, same with sales of alcohol, while alcohol is obviously a bit more noticibly enforced)

                              I thought whenever a certain ESRB rating, such as Mature, is processed through the register a screen pops up that reminds the clerk to check for ID? I know this happens for music and movies, does it happen for games?

                                Yeah, but do you find it ironic that I have personally seen kids with GTA in their one hand, a 50 Cent cd in the other, and they end up picking up an R rated movie as well. The clerk then refuses to sell them GTA but has no issues with the CD or DVD.
