            I thought something was passed that said if the company no longer produces the system or games is becomes public domain. I could be wrong.

                No. After a certain length of time, the patents they hold to manufacture the systems run out, meaning other companies could theoretically start making them, like that one company did with the NES recently (Messiah or whatever it's called). The software, though, remains the intellectual property of the publishers.
