    Take-Two Sued... Again

    Add The Warriors to the list of titles causing the company trouble.

    June 27, 2006 - Take-Two Interactive loves to keep lawyers busy! According to gaming site Gamasutra they've got a new complaint on their legal plate.



    Roger Hill, who played Cyrus in the 1979 cult-hit The Warriors, is suing Take-Two over its use of his likeness in the recent GTA style brawler based on the movie. Hill is asking for $250,000 and a court order barring the use of his likeness.

    Hill claims that Take-Two asked him for the rights to his name and voice, but then he declined to be in the game.

    Gamasutra quotes a New York Daily News report in which a Take-Two spokesman said that the company "has a valid third-party license for the rights to use Roger Hill's likeness and the character of Cyrus in The Warriors video game and related marketing materials."

    Take-Two did not immediately respond to a request for comment.

    I read that earlier, that will be thrown out of court pretty quickly. Obviously Roger Hill needs money.

        I'm working with Take-Two this summer. I just told some of the guys I work with about this. None of them were even aware. I get emails about new lawsuits virtually every day, it's ridiculous.

                Hmmm, something is fishy. Check out the paragraph I quoted:



                The statement continues: "These include disclosures and presentations by the Company of certain events, including acquisitions, partnering arrangements and earnings results; invoices from, payments to, and termination of PricewaterhouseCoopers LLP and retention of Ernst & Young LLP; acquisitions by the Company in 2005; certain compensation and human resources documents with respect to the Company and certain of its current and former officers and directors; and documents concerning the activities of the Company's Board of Directors and Committees thereof."
                Take-Two snuck that into the bottom part of the press release to "hide" behind this Roger Hill lawsuit. That quote sounds to me like Take-Two is being investigated for fraud, improper recordings of other company acquisitions, not reporting the appropriate earning results etc...

                I saw this on a blog and the blogger is 100% right. The Roger Hill lawsuit is nothing compared to the above quoted part of the statement. There's some serious allegations there.

                    I dunno. This is pretty messed up if it's true. I guess we'll know it's true if I lose my job after the company goes under lol. I think we'll be ok though. *crosses fingers*

                      To Superstar and Garnettrules, first of all, thanks lol. I'm pretty much just doing grunt work for the most part, paperwork, filing things, collating packets, financial reports, etc. However, yesterday I got to sit in on a meeting between the sales guys here at Take-Two and a couple of guys from 2K Sports. It was one of the coolest experiences of my life. I even got to sit at the table and talk to the guys lol. Everyone is really nice and easy going. Also, after the meeting yesterday, I went around the city to several retail stores to do research on what games were being advertised via posters, cardboard cutouts, mock game boxes, etc. The ones who didn't have our products being advertised, I stocked up on a bunch of mock boxes for Prey and had to talk each store manager into putting the boxes on the walls to build hype for the product. It's all pretty cool stuff. This isn't what I want to do after I graduate college, but I want to work in the gaming industry, and this is a great way to get my foot in the door and see how things work.

                            First, in reference to Joeboo's post earlier, I read through the statement on gamasutra and showed it to some of the other guys here. I don't see how it has anything to do with The Warriors allegations. Can you clarify?

                            Ok, Graphik. The first day I got here, I started asking about 2K football lol. I also mentioned it to some of the 2K sports guys to get their input. They weren't going to budge. I even went so far as to email what I though was a feasible solution to getting a 2K football game out before the license deal ends. It all revolves around two primary technologies: NaturalMotion's physics engine, "Endorphin", and the Digimask technology associated with the Xbox 360 camera that's coming soon. Hell, I'll just include the email.

                            "Hey Dave, I've been reading through some articles regarding new technologies, and there are a couple that have really stood out to me. I thought these technologies could be especially useful for the 2K Sports line of games. The desire to put oneself in the game, in the form of "create-a-player," etc, has always been extremely popular amongst the gaming community. TeamXbox recently put up an interview they had with the staff working on "Digimask Technology," which will run hand in hand with the new Xbox 360 camera. I'll let you read the article, but basically, the camera allows the user to take pictures of his or her head and the technology will create an extremely realistic 3D model based on the photos which can be imported into a game engine for use during gameplay. I believe a few games are already onboard as far as use of the technology is concerned. The second technology, (I'm working under the assumption that you haven't heard about these, but I could be totally wrong) is a product of NaturalMotion. It's a brand new, next gen physics engine called "Endorphin." The engine is revolutionary in that it all but eliminates the notion of "pre-canned animations." For example, in sports games, if a player is running, that's a prescripted animation, and that wouldn't change with the new engine. However, let's say the player collides with another player and falls to the ground, that's where Endorphin takes over. All animations take into account momentum, complex physics, etc, and every time that player falls to the ground, it will be completely unique. While completely revolutionary, and while it will most likely change the face of gaming, supposedly it's very difficult to implement into a game engine as the game engine needs to revolve around the physics engine, and not vice versa. Since most sports games are on an annual schedule, this presents a problem. There's simply no time to implement such a complex technology. I had an idea though. There has been a good deal of chatter from 2K Football loyalists (of whom I am one of the more hardcore), and I think 2K football would be the perfect fit. 2K Sports took a huge hit when the NFL exclusivity deal was put into effect. I would think the major reason why they've yet to put out some sort of generic football game (such as Blitz the League), is because of financial and business-related risks. I'd heard that a game is in the works, with no release scheduled for the near future, and a big problem they were having, so as to attract a larger audience outside of the hardcore 2K loyalists, is a big selling point. They'd fooled around with the idea of an NFL Legends game, but EA bought those rights as well as NCAA rights, so, that's basically dead. I think, if they took the time to implement some of these technologies, first with NaturalMotion to create the most realistic, most unique football game of all time, and then adding in the Digimask technology to put oneself in the game (to make up for the lack of licensed players, teams, etc). I'd even go so far as to say (if the Digimask technology allows), devoted gamers, the type of gamers who spend endless hours updating rosters, trying to keep ESPN NFL 2K5 up to date, would be able to use the technology to get pictures of real athletes, and with an expansive create-a-team feature, would be able to recreate an NFL game experience (without any legal penalties, as 2K is not involved). I think this could be a great way to get 2K Football back into the game before the NFL deal runs out, and they can take their time to perfect it seeing as they have no deadline to work under. Lord knows the 2K Football fans have been endlessly hopeful and faithful, just check out the 2K Football forum on that forum I gave you. I figure I'll end the rant here, but this should give you and maybe some of the 2K Sports guys something to digest. I included the links to both Digimask and NaturalMotion below.

                              It doesn't have to do with The Warriors allegations.

                              My bad, it's a completely seperate sub-poena that I thought was linked to the bottom of "The Warriors" press release. The allegations I listed were actually put onto the bottom of a press release regarding the "Hot Coffee" mod on GTA:SA. The Warriors allegations aren't very serious and will be thrown out IMO. The one's I quoted in my above post are quite serious.

                              Stock dropped 20% the day those allegations were released.
