Re: Bastards Broke into my Home!!!

    Rawdog,

Im fully behind you in thinking it was someone from the neighborhood.

I've been broke into before as well, and it was neighboor kids.
Lets just say that working nights does have it's privilages. You get to see a lot of things that happen. People think it's 100% surefire to get away with things in the dark. *shakes finger* I was like Dikembe Mutumbo one of those nights.

Having that gun, yes, it's a problem solver, but it could also become a problem starter.

I don't think anyone will break in while anyone is home. Now a days, for an intruder, they just don't know what they could run into. Just start snooping around your neighboors a little bit. if you think you find the rat, then do what's right, just tell them "i know what you did, if you do it again..." and leave it at that. It speaks volumes. Trust me.

It sucks you had to deal with A1 people

Like someone else said.. I believe most laws are "reasonable" force but it can get tricky at times.

yeah I have my bachelors degree in Criminal Justice... here is a little summary of what I learned about the Deadly Force issue...

        ----------
You may use physical force, BUT NOT DEADLY PHYSICAL FORCE, to stop a thief.

You may only use DEADLY PHYSICAL FORCE (gun, bat, knife, etc.) to prevent arson of an occupied dwelling or in the immediate defense of innocent life (and prevention of rape). The immediate defense of life is the BEST justification to depend on because it is grounds for deadly force in all 50 states.

Now the question of someone in your home at night arises...

You can use physical force, short of deadly, to prevent them from stealing. That is the LEGAL definition. If he is going out the door with your $5,000 plasma television your best bet is to wave goodbye to him. If you choose to confront him and he escalates the situation to a deadly force encounter you can use the gun. Since it arose out of a criminal act on HIS part you would not be responsible for escalating the situation. The question is do you really want to get into a fist fight with an unknown intruder?

        ---------

But I could care less if I feel that my kids are in danger, my wife, or myself... You can best believe that I will not hesitate to use DEADLY PHYSICAL FORCE...

In another one of my old text books I found this -----

"A person in possession or control of, or licensed or privileged to be in, a dwelling or an occupied
building, who reasonably believes that another person is committing or attempting to commit a burglary
of such dwelling or building, may use deadly physical force upon such other person when he reasonably
believes such to be necessary to prevent or terminate the commission or attempted commission of such
        burglary."

your duty is to retreat no matter what. . . EXCEPT in your home if you are in fear for your life or a family members.

I thought the only rule was as long as they are inside the house they are fair game... but if they're on your lawn or outside the house you couldn't shoot them. So basically let them inside and then shoot them, and you'd be perfectly fine. Am I wrong about that?

Wiggum: Now Sideshow Bob can't get in without me knowing. And once a man is in your home, anything you do to him is nice and legal.
Homer: [nefariously] Is that so? [calls out window] Oh, Flanders! Won't you join me in my kitchen? Heh, heh, heh...
Wiggum: Er, it doesn't work if you invite him.
            Flanders: Heidily hey!
            Homer: Go home!
            Flanders: Toodily doo!

the physical force varies by state. In Alabama, if a person breaks into your home, you have the right to kill them in self defense.

Sorry to hear your house was broken into but did you ever think that maybe this is someone you know? The fact that no electronics were stolen could be because you may see this in someones house. Just a guess. Also did you tell anyone you were going away, I ask because I am paranoid about going away. I do every possible thing I can to secure my house and I always wonder if I can do enough.

OK I just returned the long Barrel shotgun, and purchased this Pump with a pistol grip...

It looks similar to this one... Found it at the local gun shop for $279.99
