    Question regarding privacy...

    Ok, here's the story. The school rule is that no cell phones are to be used during school hours, and people caught with phones will have their phones taken and given back to them at the end of the day. While the rule sucks, that's understandable. Today near the end of the day, I got caught texting someone and had my phone taken away. Now here's where my problem comes in:

    Someone decided to call my phone and send me something. My phone was on vibrate, and my teacher saw this. He decided to pick up my phone, open it, see the "new pix msg" notification, hit ok, and look at the picture. The picture happened to be an "obscene" one. He said he could not return my phone, and it was sent down to the assistant principal who called me in. He showed me the picture, asked me who did it, and I said I didn't know. Luckily I didn't have the person's number saved. I ended up getting off of it without any problems and the picture was deleted.

    My main problem is the fact that my teacher opened my phone. It's my understanding that our privacy is protected by the Bill of Rights, and he had no right to invade my privacy like that. Am I missing something here, and did he really have the right to do that? I asked him if he did, but he came back with a response of "do you have the right to have your phone out in school?" which made no sense. I'm just curious to see if what he did was justified or not.

    I don't know if the phone is protected by the Bill of Rights but schools have leeway in what they do because they are supposedly acting in the place of parents while you're at school.

      Its kinda like when the teachers read notes aloud to the whole class after they catch someone passing them. They shouldn't do it, but the people learn their lesson.:wink: Also your school has the right to search your locker at any time if they feel its necessary. Thats just the way it is, and its fine with me if it helps keep the drugs and weapons out of our schools.

        They can search lockers because they say that they are "on loan" to students and it's their property.

          Yea I know, and part of being able to search a locker means searching everything thats in it, such as cell phones, wallets, backpacks, etc. I understand its different if you have it in class.

                    I think thats why they didnt push the fact on knowing who it was sending the message and didnt make a bigger deal than they did cause he shouldnt have answered it anyway.


                    However it falls into a gray area... if you do something against a known rule and your stuff gets taken by a teacher and while in the teachers possesion they find something even more incriminating then they have you in a tough spot cause you lost the privacy when you broke the rule.

                        I wouldn't push the issue. Bottom line is you did something you shouldn't have and you knew that. Just let it go since nothing happened.

                          Heh, I'm more of the person that takes authoritative action when given such opportunity of authority, though I keep things kept in pretty well... unless there was a murder.

                          For instance, I'm going to be an RA (Resident Advisor) for a residence hall at SDSU next year, and it is my responsibility to... you know... police the floors, etc (my floor especially). Now that doesn't mean that I'm going to go door to door every weekend night with a breathalyzer and record everybody's BAC level, but I'm going to document those that I catch drinking in the halls, etc.

                          But I'm a little troublemaker myself in situations like JJLinn was in. I used to play with fingerboards during class or whatever else I had to occupy myself. Granted, I never like text-messaging, but I have had them in the middle of class before with Blind Melon going off (I always forget to turn my phone off its ring).

                          As for the teacher, I don't know what their right was in terms of "answering" your phone, but I hope that you understand that this wouldn't have happened if you weren't texting. Really, that's all I can say, and I don't know how anybody else on OS could say anything much better on your behalf for a better solution to this unless they know about a student's rights and their personal possessions. Hence, I'm sticking to my moral.

                            I still remember a small number of people had pagers when I was in HS, and people automatically thought they were drug dealers. LOL

                            Why in the world would your friend send you a graphic picture to your cell in the first place? Your school had clear rules in place and you broke them.

                              Oh I know. Like I said, I had no problem with him taking it because that was school policy, it's just the opening my phone and going through multiple screens to get to the picture that bothers me.
