I almost never do this, but what would do you if......

I am not one for self help topics, but this one is a riddler to me. When my 360 came back I turned in the PS2 version of NCAA 2008 for the 360 version, figuring I didn't need both. Well at least I thought I exchanged the PS2 version of the game, in reality I brought back the case which must have had NCAA 2006 in it, as when I went to turn on my PS2 this weekend I found NCAA 2008 in the console and I've been unable to find NCAA 2006.

Now I did this about 2 weeks ago, and just noticed this weekend, however it was 2 weeks ago I traded the game. The girl working their was flirting with me and told me when I did this it was her last day. So I don't know if she noticed and said screw it, its FYE's problem or if she didn't even notice and just scanned the box assuming I had the game in place.

So what should I do? The way I see it I have 2 options, 1 I can bring the game back to FYE and explain the situation, or I can simply keep NCAA 2008 can remind myself it was FYE's fault. They have my contact information, if they notice and call me on it I'll definitely play dumb and "find" the game in the wrong case.

I say take it back. Sure they won't notice it and will be surprised you took it back (and likely joke about it when you leave), but to me it's a clear conscience issue. I'm picky like that though.

A minor ethical dilemma, but one none the less. You wouldn't have posted this if you didn't feel a tinge of guilt or desire to return it in the first place and truly felt that "it's no big deal".

and trade it in again for something else.

They aren't really worried about it, I would keep it. It was an honest mistake and if you want to, help someone else out who really needs it. I donate my systems to kids who don't have one and I give them a couple games. So instead of trading it in the future give it to someone as a gift.

Considering you are a lawyer, what do you think is the right thing to do? The ethical and moral thing to do would be to go back to the store and make things right.

First I am not a lawyer, I am still in law school. The code of ethics I follow mandates I correct such misconceptions. How is it ironic to ask a lawyer the right thing to do? I am sure millions of dollars are spent each day by people or companies asking lawyers the right thing to do.

Hmm tough call, for me if I actually liked the store and went there all the time and was treated fairly I'd probably correct the mistake but if it was an EB or something I'd say screw it. I've taken enough nonsense from them over the years I wouldn't feel bad about getting a free 20 bucks or whatever out of them. So in your case I guess it depends on how much you like FYE.
