    Damn, just when you think you heard it all.


    CASSELBERRY, Fla. — A police officer who slipped and injured a knee responding to a toddler's near-drowning has sued the family of the 1-year-old boy, who suffered brain damage and can no longer walk, talk or swallow.

    Casselberry Sgt. Andrea Eichhorn alleges Joey Cosmillo's family left a puddle of water on the floor, causing her fall during the rescue efforts. She broke her knee and missed two months of work.

    The boy fell into the pool outside the family's home in suburban Orlando in January and now lives in a nursing home and eats and breathes through tubes.

    "The loss we've suffered, and she's seeking money?" said Richard Cosmillo, 69, the boy's grandfather, who lived in the home with his wife and the boy's mother. "Of course there's going to be water in the house. He was sopping wet when we brought him in."

    Eichhorn's attorney, David Heil, said she has persistent knee pain and will likely develop arthritis. He said city benefits paid by workers' compensation and some disability checks helped with medical bills, but it wasn't enough.

    The lawsuit seeks unspecified damages.

    "It's a situation where the Cosmillos have caused these problems, brought them on themselves, then tried to play the victim," Heil said.

    Eichhorn's personnel file includes numerous commendations. The 12-year veteran has worked as a hostage negotiator and prostitution decoy and wrestled razors away from a suicidal person.

    Police Chief John Pavlis said Eichhorn was a good officer, though he urged her not to sue. <!-- / message -->

        Completely rediculous, if she has a problem with the diability she was or is still getting then thats one thing but to go after the family for water on the floor, are you kidding me? When I call the police for an emergency I should then quickly clean my house so there isnt anything that could cause some fluke accident to occur?

                Wow this is he definition of a frivolous lawsuit, especially because she is a police officer. Not only should a lawyer be censored for filing this suit, she should be fired as a cop, especially under these circumstances.

                Never before have I said this, and never again will I likely say this, I hope this bitch gets offed in the line of duty for that comment alone. Hell, this brilliant statement in itself could be considered intentional infliction of emotional distress, a tort itself. If I was an attorney in Florida, I'd represent these people for free and not take any part of the counterclaim for IIED.

                    Well if she has high medical bills, maybe she should have paid for better coverage. Plus she got hurt on the job, so why would she be paying the bills.

                        Family calls 9-11 because child fell in the pool. Officers/Fire Department respond, rush through the house to find the kid, one of the officers slips on a puddle of water created by the family while transferring the child from the pool to the house and breaks his leg/hip. The respondants are able to revive the kid instantly. The kid is fine, goes out side later that day to play with his friends, mean while the officer is out of work for a 8-10 weeks, while his bones heal, then goes through another 8-10 weeks of physical therapy, but his leg is never the same. Instead of being able to play softball, golf, run around with his kids, he now has a permanant limp and/or artharitis in his legs and he is never the same. He can still move around, but his lifestyle is changed.

                        What if that officer had tripped on a ditch/hole in the ground that was covered? Would it be any different? Why?

                        What if instead of it being an officer, it was the next door neighbor who was invited over and then slipped in the puddle and had the same injury? Sounds like a typical Homeowners claim. Any injury resulting on your property is negligence of the owner.

                        Does it matter in this case that the injuries to the child are more sever than the officers?

                        While an officer knows that he is signing up for a dangerous job, does that danger include the negligence (even in an emergency situation, this could be seen as negligence by the home owners) of those that called upon your services?

                          Police, Fire Fighters, Rescue Workers...

                          There is a level of danger in their jobs.

                          To sue over that danger that they WILLINGLY KNOW IS THERE is wrong.

                          It's like me suing my job because I slipped on grease that's on the floor. Maybe I should be paying attention to my surroundings. People get to complacent.

                          Again. Danger can be anything:
                          That water on the floor. A violent dog. A person with a gun. A house that's on fire. Rapid currents in the water.


                          What a crappy lawsuit.
