    So heres the deal...

I purchased a used car on July 27, 2007. As of two days ago the car no longer runs. About a two weeks before it died I brought it to the guy for a ticking noise under the hood. His mechanic told me he had no idea what it was, so I asked him if it was something terminal or if I could keep driving. Said it'd be fine, but to get it checked out soon (Which makes no sense to me cause if you can't figure it out now what makes you think in two weeks you'll have gained the knowledge to know what it is.)

So the car died and I called the dealer, he told me he won't fix it and that I could bring it back to him for some of my money back.

My question to OS is does anyone know my rights on this matter?

Did it come with a 90 day warranty? Even used cars generally have some small warranty.

Well Ive been asking around to a lot of people and Ive gotten the answer that if the car doesnt make it 90 days the sale is void, or something like that, a few times.

You buy this car from a name brand dealer or from Johny Goombatz dealership on the corner somewhere?

Johnny Goombatz, I checked though and any location that has sold at least tfour vehicles in a four month span is considered a dealer, and he's definately done that.

I don't know... knowing me I'd probably just chalk it up as a bad loss because I'm afraid what the local dealer would do to me if I asked for a full refund... i.e. break my knee cap.

How old is the car? Mileage? Did you get a written warranty? Massnole would probably be able to help best here since he's from Mass and would know where to look for the applicable laws. Maybe shoot him a PM?

Here's the best I could find:

                http://www.mass.gov/?pageID=ocatermi..._law&csid=Eoca

If he didn't give you a written warranty (which I suspect he didn't) you should be in good shape.

I'd threaten to sue if he won't give you full KBB value towards a new car.

I'm not sure what your rights are but the good news is that you've learnt your lesson. And if u really want him to get u your money back just get the car infront of his business and make a scene about how he had lied to u. Believe me u'll get all your money back because he wouldn't want a scene there. One more thing u can do: if u know some1 who's a lawyer in your family or friends just have him mail a letter to this guy and believe me he'll return u any penny he owes u.

Mass has a lemon law so you can definately do something about it. You should be able to get your money back.

Of course, you're not giving legal advice...
