    Legal experts?

    So my previous landlord deducted a heap of change from my security deposit which I plan to contest.

    My question is can I cash what he has refunded so far or would that be like me agreeing with him and his deductions?

    You should not cash it, especially if it says anything relating to it being a final resolution of the security deposit. It's better not to cash it and provide the landlord with any basis to argue implied acceptance of the amount tendered. Depending on the amount you are owed you can likely file the matter in small claims. You should also check your state's laws with respect to landlord-tenant's as some states provide for treble damages on wrongfully withheld security deposits.

                  You are legally entitled to that share of the money, so unless the check or an accompanying letter says something to the effect of cashing it is agreeing to this as final payment you should be good to cash it and still contest.

                    I would check any documents you signed at the beginning as well before cashing this.
