    Just about had my truck repo'd...wrongfully...

    So I just woke up about an hour ago (2:30ish a.m.) to my dogs going ape ****, I lean out the window and tell them to stop...they continue...so i go downstairs to lock them on the deck
    and I peek out the window to see my truck hooked to a tow truck. Shocked, I run outside in just my boxers and start talking to the man...so here is the deal...I was late on a payment or 2, called last Tuesday to make a payment and apparently I was 1 day past them turning it into repo, so I had to pay the balance, I did the following day to avoid them taking the truck. I went a step further and called and confirmed that I was caught up, they said I was.

    Well, if I am caught up, WHY THE **** did the man just come and wake me up trying to take my truck! Thankfully the man was nice and understanding, I had zero paperwork (my mother was the one that took the money to the bank because I had to work) and nothing to prove that I had payed it. All I could do was show him where I had written down the total amount owed on a piece of paper and swear that it had been done. I tried calling SunTrust on the phone but of course could not get a live person outside of business hours. I was able to convince him that I would get a hold of them in the morning and have them send something over to him. He was a really understanding - thank god! But, what if he hadn't been...or what if the dogs didn't wake me up and he towed my truck to Greensboro (where his company is out of) all the way from here (just SE of Charlotte) only to find that I in fact, WAS caught up on payments! This is absolute ****! SunTrust is going to get a pretty mean call in the morning, I hope they are ready. I feel like they should do something on their end, they should be held accountable for this HUGE mistake/hassle. Absolutely ridiculous.

    Wow, thankfully your dogs woke you up. You should feed them a nice steak tonight to show them your appreciation.

      Damn, dude. I bank with SunTrust, as well.

      Good thing your dogs woke you up, and thank goodness the man was understanding! Most tow men aren't.

        Well, the guy just came back. He said his boss said it had to be taken...SunTrust is about to catch hell.

          At least its not going to G'boro, its only going to Charlotte...but I have a feeling SunTrust isn't going to want to pay to either have a taxi take me up there/gas back, or pay to have it towed back here.

            Dang man, I thought stuff like this only happened to me! I'm sorry to hear about your plight, and I suggest that you don't even deal with a rep tomorrow morning. I would ask to speak directly to a supervisor and see how they are willing to handle the situation. If they are not willing to make this right (return your vehicle at their cost, and apologize for the inconvenience) then I would do whatever it takes to make their lives miserable when it comes to dealing with me.

              Yea, I already told my house mates that the first person that answers the phone is pretty much only going to hear "I need to speak to the highest person you can send me to"...and until I speak to as high as I can go, so will each other person I speak with. This is going to cost me a day out of work too, so its a bigger issue than just my truck being returned at their cost. I have done some reading online, this apparently is not their first rodeo as far as wrongful repossession. Its not going to be a pleasant phone call that is for DAMN sure!

                Have you found anyone that posted that they were able to get satisfaction from them? Maybe some of the lawyers on OS will chime in as far as what your options are. It sucks that you will lose a day of work and maybe incur other expenses because of their inept selves. I don't know how you feel about this, but I would probably be satisfied with them just paying to have my vehicle returned to me TODAY.

                  I could be wrong here but I don't know if there's such a thing as "wrongful repossession". The bank owns the car until you finish paying for it and they can reclaim possession of it anytime they want. Now, most of the time, the banks never invoke this right they have but if they deem the loan to be risky enough, that's when they come get your car. My guess is because of your payment history, they decided to cut their losses and go get their car back.

                    I've always wondered this as I've never had it happen to me. If you do have your vehicle towed for any reason, how do you know where it has been towed to? I know where I live there are several towing companies around. Do you just have to call around to all of them to see where it went?

                      The guy had a card ready and handed it to me, I am assuming he would have left it on the door had I not come down.

                        Oh, I called the bank, they are showing that I am up to date...the woman seemed to be just as confused as I was...she said she was going to talk to some people and find out what happened, I am waiting for them to call me back.

                          Apparently, whomever worked your account forgot to notify the repo company of your payment. Also, they won't repo for missing 1 or 2 payments....lol. You had to be 90+ days past due...lol. They'll give u 60 days, at least that's how it was when I workedfor Chrysler Financial/Mercedes Benz.

                            yea, the first of my 2 late payments was 71 days late...at 70 they turn it over to collections apparently...or so they say.

                              I would keep all receipts if you have to spend any money on this, including cell phone minutes if you have to use a cell. The bank should return your truck at their cost and reimburse you for any cost. They most likely won't give you anything for missing work, but you could try. It may take some time, but I wouldn't give up on it.

                              Also when your truck is returned, I would make sure that there is nothing missing or damaged. If something is, I would write that on the receipt and have the driver also sign.
