    Notre Dame Suing Caterer After Mistakenly Giving $29k Tip



    Colin Cowherd is going off on the lady, but I think she did the right thing. If you get a check that's bigger than what you usually get, and you're told by your supervisors that it's legit... what the hell are you going to do? Go all the way to the president to make sure?

    If I hadn't read that FOX News article (yeah, I know...) that had that line, I'd probably be on the lady too. But the fact that she tried to make sure that it was legit and then was told that it was... I think Notre Dame should just cut their losses at $29k.

    Why should she give it back? It's not her fault they made a mistake.

      She said she did the right thing, but we don't know. I highly doubt messages went unreturned.

      If they did though, she should get the money.

      Any reasonable person would think something is up when a $29,000 check is the tip on a $300 bill.

      In law the word reasonable sets the standard.

        Yeah...even if calls went unreturned I'd have just put that exact amount away in savings for a few months just to be safe...something that odd you shouldn't spend right away.

          Yes, it's understandable why someone would think something is up. That's why she asked her supervisors, who told her that it was legitimate.

            That is a good idea. Best to keep it in the bank until something comes down. If she hadn't spent it, she might have gotten some interest out of the mistake, and still been able to return the money that was mistakenly given to her.

              Thats actually a really good point. Get intrest on that money. They cant demand the intrest she earned(i dont think so at least).

                Exactly...if it's too good to be true then it probably is.

                I've read news stories about people who suddenly got tens of thousands of dollars put in their bank account, they spent it, and then the bank realized the error and sued to get the money back. Better be safe than sorry.

                  While Stewarts point is a good one and one that I can agree with. You can do a google search on "Waitress given big tip" and see feel good stories about customers giving their servers large tips for no reason other than good will. (http://abcnews.go.com/GMA/OnlyinAmer...C-RSSFeeds0312) Hell, Charlie Weis makes how many million? 29K is a drop in the bucket.

                  She could've thought it was a situation like that. If she did call the school I see no fault on her part, given that she also alerted a supervisor.

                  I will be following this one, just to see how it plays out.

                      This is actually pretty interesting, and should be interesting to see how it plays out.

                      What I'd like to know, when was it that this money was spent?

                      Surely they can pull some phone records to see if she called the school at least.

                        How in the hell do you accidentally right in $29,387 vs $29.87? I don't see how one doesn't realize that they wrote down 5 numbers instead of 4.

                          I could understand if the "." was missing, but not when a 3 was put in the middle. What will be the deciding factor will be what was on the bill. Since the article says is was marked as tip, I don't see how they have any claims.

                              It's very easy to make that typo. The 3 and . are right next to each other on the numerical keypad. I'm sure they didn't write the check, they typed it.
