College Students Arrested For Refusing To Pay Tip

Getting arrested/handcuffed over not paying a $16.35 tip ..... (insert Ozzie Guillen) "pff please"

If what those students say is true, I wouldn't have paid the tip either.

I also hate places that add a mandatory tip to the bill. Let me decide how good the service is and I will pay accordingly.

How is that a wowza? Go out and treat yourself sometime, that really isn't that much money. Apps, a few drinks each, dinners and maybe a dessert can get you to $70 with ease.

Yeah. If the students account is accurate, that was some abyssmal service.

I wouldnt of paid it either, screw that. Every where I go if i have a bad waiter sorry their tip is going down the drain. Now if our food is messed up thats fine I understand they cant control that. But like what these guys went through, they had to get their own napkins, soda, wait over an hour for salad i wouldn't of tipped either. Instead of this resteraunt so worried about getting their "tip" hire some new employees.

              1. They didn't sign a contract saying they would pay a gratuity (the definition of gratuity in and of itself defines option)

              2. "Mandatory" gratuities are often for very large parties

              3. Putting them in handcuffs might be grounds for a lawsuit against the PD. I know that section of town and, believe me, there is plenty to do for the cops considering the drugs and crime around the area..... and I'm not even necessarily just talking about the local community (after all, Lehigh U. is right there).

A tip should always be based on the level of service you receive. It should not be automatic. Servers who give good service get good tips the ones who give bad service get bad or no tips.

That's not necessarily the case, I'm no lawyer but if it's clearly stated beforehand that 18% was going to be added to your bill then the act of ordering food would enter you into that contract, no different than when you order a burger listed on a menu for $9 enters you into a contract to pay $9 for that burger.

I had this happen to me once.

Waitress sat us, took our drink order. Brought us drinks and took food order. Brought food, never saw her again. She had tables all around us and at one point we made eye contact. I had to track her down to get my check then she gave it to me with attitude. It was a place you pay up front, brother put -5 on tip and signed it crappy service and wrote the amount for 5 less.

First...the restuarant is stupid for calling the cops on the matter. Did they not think that this incident would spread bad word of mouth around town? Seriously, you're going to call the cops on a theft charge after taking $73 from the customer, since they wouldn't tip for crappy service?

Second....the crime rate in that city/town must be pretty low since the cops deem a kid not paying a $16 tip after paying $73 for their food & drinks. I mean seriously, theft for not paying a tip?

Third....the guys should've coughed up the $16. I mean come on...you spent the $73 for the meal that you waited over an hour for. Apparently you weren't too upset with the service if you're willing to go through all that. Why get arrested over $16 after all that? I understand the principle I guess, but come on guys, I highly doubt the cops didn't give you the option of paying the tip or being arrested.

The story is ridiculous no matter which point of view you look at it through.
