I used to be an adjuster so I'll give you a few tips. Take it as you want.

    1) Go to the doctor if you are in pain. In most car accidents, pain and stiffness will continue to show up for the first 24-48 hours. However, know that the other insurace company is only going to pay you for what they deem to be reasonable. If you get in a little 5 MPH rear ender and get treatment for 18 months, their likely going to call BS and pay only what they think is reasonable.

    2) They owe you a comperable vehicle while your's is in the shop.. Someone above said they got a Lexus to replace their Camry...they got lucky. We wouldn't have paid that. You have a Camry, you get a Taurus or a Malibu or what ever 4 door sedan is available. However, if you were driving a luxury vehicle, they do owe you something comparable.

    3) If you have another car and don't need a rental car, you can often settle a claim just for the loss of use...usually somewhere around half of what a rental car would run.

    4) You can choose whatever body shop you want. Often times they will reccomend one and you can choose that if you want, but if you have a preferred place, take it there.

    5) Get 3 estimates or more and make sure they are all comparable as far as what is being fixed and replaced. If your car is running and you want to get it fixed later, often times the insurance company will cut you a check and you can take it at your convenience...this is also beneficial in some cases and you can get cashed out for the most expensive estimate and take it to the cheapest one if you want.

    6) Most adjusters can usually settle your Bodily Injury Claim to a certain threshold without seeing any medical bills. Our limit was $1,000 and I know others are typically $500-$1,000. Adjsuters are typically encouraged to make an offer for even the slightest injury. I can't count how many $100 -$500 headache claims I settled.

The reason is, is that once you sign the settlement form, you are done and forfeit the right to make any other Bodily Injury Claims. So by us offering a few hundred bucks for a sore neck or a head ache, we prevented the possiblity of any future litigation.

Take it for what it's worth. If you go to the Dr. a few times, make sure you get paid for that + Pain, Suffering, Inconvenience to what you think is reasonable.

You will have two claims, one for the car (PD - propery damage) and one for your injury (BI- Bodily Injury). The settlement for one has no impact on the other.

      Speaking from firsthand knowledge?

      Hope you're okay Dook.

My co-worker's got rear ended, and still owes money on her car loan. Being hit reduces the value of your car, so if her car gets totaled her insurance company probably won't give her the "true" value of the car, so she'd end up upside down on her loan. She tried for more money, but she's kinda weak/timid so didn't fight hard.
This is so tough to prove. When I was an adjuster I'd say we paid on less than 1% of these arguments. We all know that a car in an accident is not going to be as lucrative to a buyer, but there is almost no data out there to support it.

It's just very hard to make and justify a claim for something that is potentially going to happen when you go to sell your car 2,5,10 years down the road.

As far as being upside down on a loan, typically it's the owners fault as they didn't put anything down, have a long loan (72+ month loan) or overpaid for the vehicle. If you buy a car for $25K that is valued at $20K, your going to get $20K. On a total loss, your typically going to be paid the market rate and not what KBB says for that car. The adjusters will find similar cars that are selling or have sold in your area and offer you what they feel is fair...definitely some room to negotiate and a good idea to do your own research to up the value.

I had an adjuster try that mess with me, "I would think that there shouldn't be any medical fees to pay for this". After I told him I would hate to get a third party involved, his tune quickly changed to "Here is the fax number, to have them send your bills to".

Re: Just had my cherry popped

Went to doctor and they took x-rays etc... said my neck curves like normal and then just goes straight. She said it is more than likely from the wreck as she has seen this many times. My back is also a little crooked, but nothing major.

They want me to come in and adjust my back and some other stuff. I guess it's good I went in.

BTW this wasn't a new car. This car is 8 years old and was paid off.

Yeah, just wanted to point that out...Say the car was worth 20k without an accident now, but you get rear ended again and it's a complete loss...I could see insurance companies trying to give you 10k or something because it'd all ready been in an accident, even though it wasn't your fault. It's understandable that values of cars decrease, but the accidents shouldn't hose you over if they're not your fault.
