    Notice I said if he missed work, required medical attention, etc... None of us know, necessarily, the whole story, and for everyone to tell him not to sue is premature in my opinion. It's his choice and I think this mentality is what is wrong. Of course he should get what he deserves. But none of us know what that is besides him. Let him decide, all doors are open for him... don't tell him not to sue.

    I wouldn't sue in this situation, FYI, assuming I wasn't seriously sick. I'd definitely talk to store management, though.

      Yep, skimmed over that, my bad.

      I can't speak for anyone else but I am basing my opinion off of the assumption that if this were any sort of a serious illness, he would have mentioned it and in all likelihood would not be posting about it the following day in which case I can't see any possible scenario worth suing about.

        I'm sorry, but I always check the date of EVERYTHING I buy at the food store. When I would rotate stock at Wal*Mart I'd constantly find stuff 1-2 years past expiration.

            Yeah I saw a lot of stuff also that was expired when I worked at Kroger.

            My wife tells me to just get stuff from the back, but a lot of the people who stock do not rotate. And you will find the new stuff in the front and stuff from the Ice Age in the back.

              Without knowing any better, I am going to guess we are talking about a dried chinese style shelf stable sausage, not fresh and probably not even from china (does the USDA even let in imports of chinese meat?).

              Anyway, I always check dates on the refrigerated/fresh stuff I buy, but I can't say I ever think to check stuff off the shelves.

                It said sell by May 2007. I feel a little better now. Like I said I am just going to let it slide. Probably won't shop there anymore. I'm just gonna take as a lesson to be learned and be more cautious and look at the due dates on everything I buy this time.

                  As much as I dislike Wal-Mart, when I worked there in the produce they had us pull everything a day before the sell by date.

                  It's good and bad, they throw away A LOT of good food.

                  Off topic, but if you ever buy bananas grab some that are singles or double. We were told to throw away those because they didn't want to rack littered with 1 and 2 bunches.

                    Actually now, Walmart gives away their expired food to the food bank to be shipped to Africa and other 3rd world countries.

                        Ex - Offtopic...Got comp'd on a meal from Carrabba's on Friday. The wife and I had to wait about 25 minutes for our Chicken Marsala order, and when it did finally come out -- a few bites into the meal -- I notice a piece of green gum on the outer rim of the plate.

                        Pointed it out to the waiter and he took $16 off the bill. The manager came by too, and wanted to know if there was anything else he could do. He offered to take it back, and give me a new one for free. I told him I have a 2yr old son who's here with us (wife had taken him to the potty at this time), and that I can't afford to wait another 15 minutes for food while he begins to get continusouly un-ruly; get it right the first time...
