Tenant's rights question.....
Early this morning my girlfriend was forced from her apartment due to a fire next door that from what we've heard started in their air conditioning unit. She's ok physically and staying with her parents. But she's afraid all her belongings are too smoke damaged to save. She didn't have rental insurance and was in the middle of a lease. Is there anything she can get from the people who run her complex? Even the rent money she just paid 48 hours ago?The New England Patriots cheated to win four Super Bowls.Tags: None -

Was it this apartment by chance?
Glad she's okay. The only thing I can say is for her to look at her contract and talk to the realtor or owner of the building. If it was the incident described in that article, it looks like they had a somewhat antiquated alarm system.Steelers : IX, X, XIII, XIV, XL, XLIII

Being that each apartment has a smoke alarm in it, I highly doubt it. If I was her, I would get some febreeze and febreeze the hell out of stuff before I throw stuff away.Last edited by Gotmadskillzson; 07-02-2010, 06:41 PM.Comment

I can answer for the VA/NC area as I use to work maintenance.
If the fire started by AC and wasn't due to poor maintenance/ faulty workmanship...she's probably screwed.
But If the fire did start due to a faulty AC...she needs to wait for the fire marshall's report and use that to seek recompensation.
If the fire started due to another residents negligence...she needs to file with their renters insurance or sue them for damages.
Either way, it's in her best interest to leave her belongings alone untill the damage is assessed by the responsible party's insurance and/or her own independent assessment by a professional agent.
Let me add, this was all from a few years back and was at a few location in just these two states...things may have changed or are different there.Comment

Either way, tell her to get renter's insurance ASAP.
My mom hassled me to get it and glad I did. Less than 4 weeks later, half the apartment went up in smoke (my building was 5-6 steps away from those on fire) Then a few months after that my apartment was broken into. Got everything back from the insurance---which then dropped me from coverage after paying out.
And it's relatively cheap.Comment
