From what relatives said in Virginia 20 over automatically brings the reckless driving charge with it. My advice is to hire an attorney and let him take care of it for you.

Really? Do you know how many people are killed each year by speeding crashes? 1/3 of all fatalities from cars are caused by speeding, so I would say its pretty serious. if it goes down to 35 mph there is a reason, probably becuase it is a residential area where people are, and if you are going 20mph over, that is a big deal."Basketball may have been born in Massachusetts, but it grew up in Indiana." - James NaismithComment

Does the reckless driving charge come with a sentence of more than 6 months? If so you should get a court appointed attorney if you can't afford one. Now if you have to represent yourself, ask the DA for a Continuance without a Finding (CWOF), which would have some probationary period but if you don't get in any other trouble it wouldn't be on your record.Comment

I was caught doing 80/65 in Alleghany County near the West Virginia border. I thought the cop was going to let me go since he was an ex-marine and saw my marine corps cover in my back window but he didn't. My ticket wasn't that bad though I think like $130. Usually states, counties and cities that have severe speeding penalities is because over the years a lot of cops or road construction workers been either hit or killed by speeders in their area. So therefore they crack the whip HARD.
I remember a couple of summers ago in Indiana this 19 year old kid was doing 140mph in a 35mph zone. Why ? Because he was at his girlfriend house getting busy and looked at the clock and seen he was going to be late for curfew.
Boy ended up hitting a pothole, car went airborne and hit 6 cars, including a state trooper car., ended up killing this mom and her 6 month old baby.
Needless to say Indiana cracked down HARD on speeders after that.Comment

I dont know if its the same, but south of you in NC is where I live. I got caught going 60 in a 45 by a trooper and he gave me a citation. I was on my moms insurance then so she threatened to take me off if I couldnt get it dropped. I hired an attourney and since I never received a ticket before I got it reduced to improper equipment and just had to pay court costs and the ticket and it didnt go on my license or insurance. It cost me about three hundred dollars for everything.
Again, I dont know how it works up there but you could ask for a prayer for judgment as well if they have it.Last edited by hatisback; 07-08-2010, 01:15 PM.Comment

Just got my first ticket today.
Was booked going 56/35. In Va. that's reckless driving which also happens to be a class 1 misdemeanor (same level as a DUI). Right now I'm looking at a possible fine of 2,500, 6 points on my license and a permanent criminal record.
For the OS attorneys out there, how do I plea this down to 19 over? I was very polite, its my first ticket, and the road switched from 35/45 when you cross over county lines.
IMO, it comes down to whether you think it would be better to have this on your record and pay the $150(rounded) fine, or if you think its worth the cost of getting a lawyer to get it dropped. For my last ticket I was looking at over $600 for the lawyer but only paid $150 for the ticket total. You may end up paying a little more for insurance but for me it was hard to tell. If you cant tell already I was a crazy driver when I was young but have calmed down alot.
Oh and you can get 22 over and not have it be a reckless driving ticketComment

I got a ticket a few weeks back. Clocked doing 64 in a 35. The ticket said 60 in a 35 though. Ticket cost me $184. Since I have a good driving record and never had a ticket before, if I don't get another ticket over the next 6 months it does not go on my driving record and no points off my license. I have done the speed limit everywhere I drive since.Comment

Yeah the kid been watching the fast and furious movies way too many times. He even had his mustang tricked out to look like one the fast and furious cars. I know of the day of court one of the people said I hoped that girl's arse was worth it, because the judge gave him 50 years.Comment
