    Anybody have good advice after getting in an auto crash?

    I came to a complete stop at a red light and I was rear ended by another vehicle. I have minor neck pain and there are a few cracks to the bumper of my vehicle. ('07 Infiniti M45 Sport)

    All of that is being documented in the report and the driver of the other vehicle has insurance.

    What steps should I take to gain restitution from this crash?

    Here is what I have lined up for tomorrow:

    #1 - See a chiropractor for my neck injury
    #2 - I already have a tune up planned for tomorrow, so I'm going to have them take a look at the damages. Well what they can at least. The bumper might need to come off to diagnose the interior damage, if any.

    Questions I have:
    *In reference to giving a verbal statement to an insurance company, I would rather give a written statement. Is that acceptable?

    Any other advice would be greatly appreciated!

      Yes a lawyer would have better advice, hopefully he doesn't charge $100/post.

        I got blasted by a driver from behind while at a complete stop. It was such a hit that I got pushed into the car in front of me and that car got pushed into the car in front of him.

        We all got out and agreed to talk in the parking lot of the MNDOT facility that was off the road that it happened on. Biggest mistake I made was not noting the liscense plate of that douchebag.

        Unfortunately, the guy that hit me pulled into that parking lot before any of us could and slipped out the other side. Those of us left all gave our story to the police and I was saddled with all of fault by the insurance companies because I was "stopped too close to the car I got pushed into"

        My insurance cost a lot of money after that for a couple years. A crock of **** for sure, so I'd tell you to bitch and moan about everything and make it clear that nothing was your fault.

          That is a terrible, terrible story Tim. Being in the profession I am the first thing I did was write down the license plate. I was very relieved to see the driver had insurance.

          Well I might miss work tomorrow night. My neck is sore on the left side, which makes sense because I was looking left when I was hit. I can't be physically hampered in my profession because you never know what might happen. I wish this never happened because the burden of going to the chiropractor and getting my car fixed is going to take dozens of hours out of my free time.

            Most Lawyers give a free consultation. Definatley have one in your back pocket just in case. The insurance company is going to do their job and thats to make you go away with as little money as possible out of their pocket.

              In all seriousness though stew just let your insurance company deal with the car stuff. Any half-decent insurance company will send out an adjuster to assess the damages. After that they should cut you a check. Get them to make it out to you though so you can shop around for the lowest repair price. I'd talk to a lawyer about the other part if your injuries persist.

                Thanks fellas. I'm going to let the other driver's insurance company deal with the car stuff and will report to them all the costs associated with my injury. I'm going to record mileage used to and from the chiropractor, gas used, and my personal time spent during these visits including travel time. I believe it is necessary as the negligence of the other driver is the sole issue that I am doing all these things.

                  Ummmm I would take lots of pictures of the damage to your car. Preferabley with the time stamp on it. That way there can't be any dispute over how much damage was done to your car.

                  I have learned people will lie their arse off and call dents scratches.

                    I think you will need a few estimates from the other party's insurance company.

                    Also, in the state of Wisconsin, if you are on the road and you are involved in a car accident and it's not your fault, you are still at 10% fault for being on the road.

                    My wife was in an accident that totaled our car and she had back pain and was pregnant. She asked about future back pain and they said the settlement was enough.

                    So, you might ask them to cover future neck pain if it persist.

                          I still have more Degrees than you. You should wait to go back to work. I am sure it would be hard lifting a doughnut with a neck pain. All kidding aside glad you are OK for the most part bro. Getting the car fixed will be a bitch and I am sure you rates will go up too. But good luck getting everything you can.

                            Off the bat the insurance company has been 100% professional and polite while expressing concern for my well being.

                            In NC the insurance company of the driver at fault accepts 100% liability, so I am fortunate.

                              Did she or you accept a payment before you claimed there was back pain? Never accept any payment or sign anything until you are sure it includes everything that you believe that you are entitled to. Accepting payment can waive your rights to any future claim.
