You must meet all 4 of these rules for her to claim you:

1. Relationship - You are actually her son.
2. Age - Under age 19 at the end of 2010 OR under age 24 and a full-time student for 5 months of 2010.
3. Support - You did not pay for more than half of your expenses during the year.
4. Residence - You had the same residence as her for 183+ days during 2010 (not necessarily consecutive).

If you fit all 4 of those, she can claim you all she wants. If you don't, she did her taxes wrong. But they'll never catch her unless you turn her in.

2 and 3 don't qualify...2 definitely doesn't.

The question then becomes:

• how does one turn in a person for incorrectly filing taxes?
• what are the consequences? i.e. if there is jailtime involved for a guilty party, can JJ really do this knowing he could be throwing his mother into jail?
• is the $500 JJ stands to get back really worth the time and effort?

The plot thickens.

He could claim himself as a dependent and collect the money now. Then when the IRS (probably 3 years down the road) audits him when they find out he was a deduction on two returns (his own and hers), he could prove his age pretty easily. Then the IRS would go after her and she would owe a crap ton of interest on top of whatever tax she owes on the deduction for a dependent.
