He's referring to the registration and insurance information of the car that was being driven at the time the ticket was given. That's information that would/should have been recorded.Member of The OS Baseball Rocket Scientists AssociationComment

Sounds like 1 of 2 things is happening here. Something like an acquaintence of a friend of a friend has some legal trouble following him and is screwing the OP over. Or someone has the exact same name as you and something got screwed up along the way. Is your name really common?Comment

How about a license plate number?
Is any of the relevant information public record?Member of The OS Baseball Rocket Scientists AssociationComment

Try to obtain a copy of the ticket. If the information isn't correct on the ticket, (they would have had to either give a SS# or provide their Drivers License Number as well as the vehicle they're driving and an address for the offender), then they can't enforce the citation. Some citations have height/weight/eye color/hair color. I'm not sure what the laws are where you are, but I ALMOST wrote someone a citation in someone elses name. They had a warrant, and gave their brothers name and information. I nearly let it pass, but I had a very sneaky suspicion that he wasn't being honest. Asked several more questions, and ended up arresting him.
To the above, there will be no "defamation" charges, lol, Identity Theft, possibly.
First things first though, get a copy of the citation, it will list the DOB, if that's incorrect, show some sort of valid proof that it's not you. There is the possibility that it was a mistake.
If they didn't have an OL on them, a lot of the time they'll call into dispatch giving just their name and DOB, and it'll come back with a OLN for you (or someone else if they have the same info).
Start with the citation though, if you have any questions, let me know and I'll try to help what I can with your questions man.Last edited by WTF; 06-06-2011, 10:40 PM.Twitter - WTF_OS

Are u a cop? Who do I need to go to? I tried everything from writing appeal letters and going to the Superior courts which they told me too and even tried to ask for personal records and everyone has declined to let me get personal info. This whole process is really getting me frustrated.Comment

My name isn't common and I have a 1 of a kind name. I have a feeling its someone I know and I've been asking around but no one is saying anything. I just want some personal records of the car plate and a word with the officer who pulled that person over. If its someone I know I might have to go toe to toe with him.Comment

Re: Someone Used My Name (Fraud) on a Speeding Ticket and I Can't Appeal
Go to your County Clerks Office, which is where the tickets are normally payable prior to court. If there is a ticket/citation written in your name, they HAVE to give you a copy of the citation. All the info you will need will be on the ticket.
Tell them you've never received a ticket, and would like a copy of the citation which is keeping you from obtaining your license. Different states handle things differently, but I'm almost positive all use the County Clerks Office to handle traffic violations.
But just go in there and have them pull the citation. If it was that recent, it was probably an E-Citation, so they won't have to dig through paperwork, just pull it up on the computer and print it.
If that doesn't work, then I'd ask if you could at least see which agency (local, state, sheriff, etc) wrote the ticket. Go to their Command Post/Office and see if they will assist you. Just tell them the story that you posted and say you need a copy of the citation. A Sgt or Cpt should be able to get the ball rolling in the right direction for you.
Obtaining the ticket is the biggest key on finding out who it was that misrepresented themselves. Chances are, you'll get a copy of the ticket, and look at the make model & year of the vehicle, and know right away who it was.Twitter - WTF_OS

Is there a video of the pull over? Also, if there is a car with no registration, insurance, tags and a driver with no license the driver goes to jail in Arkansas.Comment

Maybe you can search internet forums for a thread titled "Just Used Someone Else's Name on a Speeding Ticket and I Got Off Free".
But in all honesty, I hope this works out for you, man. Sounds like a frustrating mess.Comment

</td> </tr> </tbody></table> Same thing happened to me about 10 years ago but it was my brother that used my name. I asked for a positive ID hearing and the officer that issued the ticket was required to attend. Of course the officer had never seen me before and my liability for the ticket was dismissed. My brother got in a whole heep of trouble over that but it was nothing new for him.
