Copyright Issues with In-Game Band Music?

    What’s up guys,

I recently got a warning from Twitch (I stream, @gamedaygaming) saying I had some copyright violations. I don’t play music on my streams. So I checked and I was flagged for in-game band menu music and in-game band music when playing against various teams. These were the 3 issues:

    Copyrighted Work(s):
Snare Force One by the Blue Devils
Drum and Drummer by the Blue Devils
Holy Cowbell by the Blue Devils

Has anyone else had this issue on YouTube, Twitch, or other social platforms when playing or uploading content? I was completely thrown off because the in game sounds are part of the experience but I may have to cut out in-game sounds moving forward. Just wanted some insight from others on this. Appreciate it!

I saw Mills tweet about it yesterday that the band music owners is getting people now for copyrights on it. Sounds like its a recent thing and started after the game.

As someone with a lot of concert videos on youtube they are super strict now so basically everything gets a copyright claim now.

Yeah, I understand it I suppose. Especially on YouTube. And I knew it could happen if you play music in the background, but I didn’t expect it to happen from music from inside the game.

My guess is I’d likely have to mute the in game music?

Appreciate it! I also read on Twitter that it’s been happening recently. A couple of the creators of the band music are going through and issuing warning and striking folks. Looks like I’ll be turning off at least the menu music!

Ive been watching this woman play thru Fallout New Vegas on youtube and she says she has to play with the ingame music off or she will be flagged. So its not just this game but any game with copyrighted music.

Yeah, like I said, I shouldn’t be too shocked but I was a little with the band music. But, if it’s copyrighted music, they have the right I suppose. I’ll likely mute menu music and try to be mindful of the in game band music as well. Appreciate the responses, guys 👍

A copyright claim doesn’t matter unless you’re making $ off your YouTube. If you aren’t then it’s nothing to worry about and isn’t going to affect you. If it’s just music then it’s almost always just a copyright claim. Live music is better then real recordings thats why reaction videos are of live music. However a copyright strike I think it’s called is a major deal this is typically for stuff like uploading a tv show. You only get a few of these until it’s banned.

I upload a lot of stuff to my YouTube that could get copyright stuff on cruises and theme parks. Here is the trick schedule your videos to go live in the future, if it gets you a copyright claim then it gives you the option to replace it. In the video game it would be very simple it would just likely mute your words as well

A number of games now have a flag in the settings to replace copyrighted music specifically for streaming.
Bills, Sabres, Illini, Cubs, basically any team that abuses its fanbase and I'm there.

I was flagged for this about 10 years ago for the crappy music that played during the post-match highlights in FIFA. The warnings wanted me to let the copyright owner monetize my videos.

I only had like 100 subs so, rather than let the copyright owner (who was already paid to have their music in the game) make one cent off of my videos, I just deleted them all.

It's annoying. I have a few live performances of rock shows from the 70s and 80s uploaded on Youtube. Most of them are either black screen with text describing the show, or album artwork from the bootleg that was created from the show. I got a warning 2 months ago that my video would be taken down automatically in 7 days and I would get a copyright strike, or I could take it down myself and nothing would happen. It was from one of the photographers who took one of the pictures in the album artwork and only applied to a minute and a half of the song. I took it down, and reuploaded with generic black screen and white text as I still have the audio. The annoying thing is not only was that video not monetized, nothing on my entire Youtube account is monetized.

I don't stream but I want to say that if you click R3 in the menu to bring up the music, there is a checkbox to enable or disable music for the purposes of streaming. I've never tried it and frankly I set all my menu music to 0 anyway, but you streamers may want to take a look at that and see if it kills all copyright music or just all music period the same way setting it to 0 does.

The copyright bots on YouTube are out of control so it doesn't surprise me that they are out of control on Twitch too. It is surprising that the music EA picked for the menus isn't fair use under the original license but I guess that license only applies to EA and not streamers. There are a ton of fight songs and other team songs that aren't in the game because of copyright issues (Nebraska's Hail Varsity being one of them) so I figured anything in the menu was fair use. Guess not. Hope the R3 music menu setting does the trick so you don't have to constantly mess with the volume.

A number of the bands play copyrighted songs during gameplay, so you'll definitely want to use the turn off copyrighted music setting rather than the volume slider.

As a separate note, there seemed to be a bunch of menu songs that were unchecked by default so turning those on improved the variety of menu music.

Just for clarity, are you guys only talking about menu music (which I have turned off, not just muted out of personal preference) or do you also mean music in played games played over the stadium speakers or by the bands sitting in the stands (I.e. Mr. Brightside, Enter Sandman, 7 nation army, etc)?

last year post launch the menu music from the band song that played all the time would get you a copyright. I always just mute it and do voiceover for the videos I make.
