The point is where the publishers choose to spend their money. Budgets aren't unlimited - $250,000 (or whatever) spent on getting rights to a bunch of songs would be put to better use if it was used...

A waste of money and resources. What the heck does a soundtrack have to do with realistically replicating NFL football. Get rid of the soundtrack and use that money to beef up the gameplay.
