The issue is by other accounts this seems to be a trend. Infamous, also a first part game, didn't get out at 12:01 either.

If they can't deliver at 12:01, than don't use it as marketing tool.

The intention is to get it out by 12:01. I think we all forget this is being done by humans, no one is perfect. Are you telling me that you have 100% delivered on everything you've promised in life. Don't get me wrong, I'm disappointed it isn't out yet. I'm just saying that this is obviously a snag on their end that I'm sure someone is getting heat for.

Go to Wal Mart, some of those stores wont' have employees that will sell it to you. That happens more than you realize. If you want a guarantee, go to Gamestop at midnight. Some digital releases have no issues, some do. I've been down this road multiple times. Patience is key. Plus side is even though I'm waiting, I didn't have to leave my house and I could have more beer!
