Ya I was gonna say "illegal"? slow down Al Capone lol. Nothing illegal about it. You just don't do it because if you break street dates companies aren't going to send you games early. Walmart and Gamestop have no benefit in selling games early because people are going to buy games from them regardless and also because of the ill effects it would cause the relationships they have with gaming companies. The mom and pop stores are the best bet because they have so much more to gain with honestly little to lose. They are the underdog against those big companies and really need your business. Margins for a mom and pop store are quite simply brutal and I would hazzard a guess that they are the worst in all of retail. Alot of those stores are going to take any chance to get more money out of you. So basically a mom and pop store will either sell you the game early to gain you as a loyal customer or sell it to you early for more money. Mom and pop stores also usually deal with a wholesaler not companies directly and when I had my store they really couldn't care less what I did from what I could tell.2016 NLL Champion Saskatchewan Rush

As for ''breaking street dates'' I dont thinks its illegal as much as it is against policy.
I assume any store thats not a momNpop are big box stores and they want street dates as a professional courtesy to each other. As for the angle of why the companies that actually make the product agree to street date policy, I dont know.
There are several momNpops near me and I always check anyway, but they never seem to get it early. Sometimes they dont get the game for a couple weeks, or a month, and sometimes they never get it.OSFM23 - Building Better Baseball - OSFM23

While it is not "illegal" to break street date, it usually does violate a contractual agreement and can lead to fines or a company not getting early shipments of popular games early to sell in the future.
The seriousness of this has seemed to fall to the wayside a bit in the last couple of years but it can have pretty hefty fines or issues with future distribution.
As an example I am a partner in a local Comic Book store. We pay to get our books on Tuesday for new comic day, which is every Wednesday. This allows us to do inventory and have the books ready to go when we open. Other stores nearby have used the same opportunity but have broken street date and been caught doing it. They have been fined and have now lost the privilege to get books a day early. So they usually don't get books until late afternoon/evening on Wednesday, while we have all new releases when we open our doors.
While this may not seem like a big deal. Think about it this way. You have two identical stores, selling the exact same product. One store has this product available at 9am and the other store does not have the product available until 6-9pm the same day and never at the same time. This difference can lead to success or failure of a smaller non chain store. I'm sure you all know this, but if not, here's my secret! On ebay, I set a search alert for, "mlb the show in hand ready to ship." I got 15 by doing that on the Tuesday before release!1458, not counting playoffs, that's the number of games in a row I haven't missed! Go Yanks!Comment
