Is it true about the Class Action Law Suit?

I've heard that some people without XBL are fed up with this whole "patching" issue and are about to file against 2k and others. They claim this has been in the works over the last few years but 2k and EA have sent them new games. But companies have made promises not allow this to continue and this game has put them over the edge.

Dont shoot the meesenger! just what i've heard...

Well, if you only get a patch to them via Live, and there are those who can not get a patch to a game that is fundamentally broken out of the box in a certain area, I can understand the pissed off people will get.

Right, these companies need to have a procedure in place to get critical patches to people who don't have XBL. I'm surprised that something like this hasn't come to a head sooner.

All part of growing from a hobby to a mainstream entertainment industry. Publishers wanted the big time profits so they must learn to deal with the big time pains as well.

I kind of hope it is true because publishers will have to start doing the right thing by the customer (ie holding release dates in order to finish/test games properly). But then again, it may just means publishers will stop fixing their broken crap for everyone.

I don't blame them at all! That is pretty messed up.

people know about it before hand so if someone here goes out and buys the game that doesn't have live, it's their own fault.

do you need a gold account to get patches, cause with ps3 you don't have to pay anything.

Nope, they are free. All you need is an internet connection. And if you don't have one, just take it someplace that does. In today's modern world, it's pretty easy to find someone with an internet connection you can use for 30 seconds to download a patch.

On the internet or this site maybe. But that makes up a small minute percentage of people buying the game. The average person that makes up most of the sales does not, and thus it isnt their fault.

It is always the publishers/developers for pushing out this type of trend.

Not everyone has that luxury. There is a lot of rural gamers out there.

IMO the company shows no hesitation to take the consumers money for their product, then they should be willing and able to make things right for all of their customers irregardless if they have or have access to an internet connection. It is a matter of good will building and just plain good business practice.

I don't have Live and I agree with that. I just accept it as my problem.

Sure, but ultimately it's my decision to purchase the game. Not like the power company cutting services and raising rates, or some other situation where I have no real choice.

And not everyone (READ: Majority of customers) is attuned as us on here knowing these problems exist. 2K sure as hell is not going to advertise, "hey, buy our game, but the franchise is fundamentally broken, and there is no fix without an internet connection".

So those who get it, without knowing this, are the ones that pay the price ultimately. And quite honestly, should be compensated with a refund, or some other ways of getting these fixes addressed.
