Portland got concessions based on their claims that he was no longer physically capable of playing basketball.
He clearly is still physically capable of playing ball.
If other teams want to sign him, so they should.
Portland issuing legal threats is very weak IMO.
The Portland Trail Blazers sent an email to rival team executives late Thursday threatening possible litigation to any franchise that signs free-agent forward Darius Miles for the “purpose of adversely impacting the Portland Trail Blazers’ salary cap and tax positions.”
The email cites Wednesday’s Yahoo! Sports report that if Miles plays in two more games this season, the remaining $18 million on his contract goes back on the Blazers’ payroll.
“The Portland Trail Blazers are aware that certain teams may be contemplating signing Darius Miles to a contract for the purpose of adversely impacting the Portland Trail Blazers Salary Cap and tax positions,” Blazers president Larry Miller wrote in the email to representatives of every NBA team. “Such conduct by a team would violate its fiduciary duty as an NBA joint venturer. In addition, persons or entities involved in such conduct may be individually liable to the Portland Trail Blazers for tortuously interfering with the Portland Trail Blazers contract rights and perspective economic opportunities.
“Please be aware that if a team engages in such conduct, the Portland Trail Blazers will take all necessary steps to safeguard its rights, including, without limitation, litigation.”
Teams had been under the impression the collective bargaining agreement demanded that Miles play 10 regular-season or postseason games for the $18 million – which is split evenly between this and next season – to return to the Blazers’ payroll. But the league office confirmed to Yahoo! Sports that the six preseason games that Miles played for the Boston Celtics counts toward the 10. Before the Memphis Grizzlies waived him on Tuesday night to avoid guaranteeing his contract for the rest of the season, Miles played two regular-season games that pushed him to eight total.
“They’re daring someone to sign him now,” said one Western Conference GM who had seen the email from the Blazers.
Any team in the NBA can sign Miles to a 10-day contract, play him twice and punch out one of the summer’s top free-agent destinations. The Blazers are a prime destination for free agents, and the cap space also made them a fierce competitor for sign-and-trade deals. If Miles returns to the salary cap, he also will push Portland into the luxury tax. That means every team under the tax would benefit with about $250,000 of revenue sharing from Portland.
“The point that everybody is missing is that this isn’t about Portland’s salary cap. It’s about whether this guy [Miles] is healthy enough to play or not,” said an Eastern Conference executive. “He obviously is healthy enough to play. It doesn’t matter how good he plays. He can still play, and they said he couldn’t.
“Portland received benefits when [Miles’] injury was ruled career-ending. If he can play, they don’t deserve to have those benefits.”Comment

Is Miles really playing basketball or is he simply a warm body out there taking up space until he can get his payday and bolt? The guy has always seemed to care more about his money then anything else so I have a hard time believing that this is a legit attempt at a comeback.Comment

What's funny is that it was an independent medical examiner jointly appointed by the NBA and the NBA Players Association that examined Miles and determined that the damage to Miles' right knee was severe enough to qualify as a career-ending injury.
It's not like Portland brought in their own doctor in order to reap benefits off of false claims...
It's pretty simple, they were wrong.
I worked with Govt. medical advisers for severaly years...you get 10 together in a room and you get 5 different opinions.
He obviously is fit enough to play.
Chef...even if it's 10 mins a night, that's still physically capable bro.
You ONLY are allowed to be medically retired if you...literally...can't physically ever play again. That's what the rule was brought in for.Comment

Seems kinda silly to think that Portland could sue anyone and win but I guess they either think they can or they think they can scare other teams into not signing him. The problem, if that works then cant Miles sue (like the article mentions) the Blazers for prohibiting him from making a living in the NBA? I have no doubts that Miles is only doing this in an attempt to get his 9 million salary but it seems like a complete joke if thats the case and while I normally dont wish injury on anyone, if Miles is really doing this just to get in the 10 game minimum so he can cash a paycheck and bolt again then I hope he blows his knee out for good during pregame warm ups right before the 10th game.
If all it took for me to get $9mil (which was gauranteed to me in a contract) was to play 10 games then I would do it...in a heartbeat.
Not out of spite...just to get money. I don't owe anything to the fans...the trailblazers do.
And therefore they should've gone about things the right way instead trying to find a loophole to clear this contract off the books.
Now it has clearly come back to bite them in the kiester, and you can say all the 'NBA appointed doctors' hoopla but it doesn't fly...Heck the NBA probably wanted him out of the NBA as bad as the Blazers did they just didn't have significant grounds to suspend him so why not medically retire him?

Don't see the Blazers are allowed to threaten teams not to sign a guy. That's hilarious and messed up. Sure Miles screwed up a lot before, but people here are quick to let Steph off for his past transgressions.

Miles can still play, so if he can, let him. To threaten teams shows very poorly on the Blazers organization.

Also, let me clear up a misconception here.
Miles is still getting paid the amount of money stated in the contract with the Blazers.
He is getting his contract money through a mix of insurance, the NBA, and the Blazers iirc. Insurance might be the only ones paying him; the Blazers pay Miles, and the insurance company reimburses the Blazers. He is still getting the money that his contract with the Blazers state.
The problem here is that the Blazers don't want to have his contract count towards the salary cap, not that Miles has to play 10 games to get his 9~ million.Last edited by Kully; 01-09-2009, 10:21 AM.Comment

Basically. LOL at condemning Miles and defending the Blazers in this situation when he's getting paid regardless. He's played games with Boston & Memphis and both franchises had nothing but good things to say about him during his stay. Players are on record stating that he's still got alot of game left in him, and the Blazers are pretty much trying to stop him from playing. What basis would they possibly have for pursuing litigation? Teams sign guys to 10 day contracts and play them 2 minutes a game in 3 games all the time.Comment

The Miles situation is getting weirder by the minute lol.
Apparently the Cave owner didn't like the "threatening" email sent by the Blazers owner, and sent one back himself. It's getting funny.
