I guess I see it differently from you...because I see (1) he lied to police straight off the bat, (2) he admitted there was no spoken consent or discussion of sex, (3) he admitted she said no and then said he stopped, but yet his semen was found inside of her, (4) he admitted it was rough sex (when he said to ask Michelle about the strangling thing)...if he didn't ask her about strangling her during sex hard enough to bruise her neck SHE DID NOT CONSENT TO BEING STRANGLED and it is RAPE, and if she is being strangled it would be reasonable for her to be afraid and unable to run away or fight a much stronger individual, and (5) Kobe admitted that even though he was "big," he "slid in easily," meaning the bleeding and injuries the victim had were a result of his roughness, which is something to which she did not consent and also the officer said the injuries were not consistent with "five minutes of intercourse."

            That sounds like a less-than-innocent man to me...

                Dang, Autoproxy you hit it on the head with that one. I remember long before this whole situation came about, an episode of the "Best Darn Sprts Show Period" with Jim Brown. Jim was talking about how he had been in the Lakers locker room one time talking to different players. They asked him about Kobe and did he meet him and Jim said something to the effect of, "He couldn't relate to Kobe b/c Kobe had no respect and Kobe was from a "different world" from which Jim was used to."

                I can see Kobe acting like this, and just totally blowing people off who come up to talk to him.

                All I can say is hopefully Kobe has gotten his life right with God, and with his family and he needs to live up to the reputation that he had fooled most of the people with in the first place.

                    1. Kobe lied to police because he was caught in an extramarital situation. His reputation could have been sullied by any hint of sexual impropriety. In Kobe's mind, other guys (like shaq) thwart these situations with a simple payout. Men when caught in extramarital liasons will usually lie in the beginning.

                    2. Consent was given when she dropped to her knees and gave a bad bj.

                    3. She said no "when kobe asked her if she likes for a guy to bust in her face." Kobe did not do this.

                    4. There were a thumb size bruise on her jaw, far from strangulation marks on the neck. Mark not even visible to detectives.

                    5. Remember, that the prosecutors' paid expert (michael Baden) concluded that the localized trauma in the vaginal region were consistent with consensual sex. No evidence of forced entry.

                    Let's not forget this girls slovenly behavior in regards to sex.

                    Auto, the girl went to the room to seduce Bryant. She was going through all the motions of "making lustful love". Kobe wasn't having any of that, he just wanted to bust. When she saw that she was nothing more than a 5 minute interlude, her unstable emotional side took over. The side that attempts suicide to garner attention. The side that brags to friends at a party, giving lap dances (with pictures posted in the tabloids) just a few days after this so called traumatic episode. The side that treats sex with men as a sport and engages in high risk activity with illicit drugs. The side that conjured up this dispicable outrageous claim to garner sympathy, yet bail when those well wishers became skeptical.


                    With this information coming to light, it's evident that there was no settlement. She didn't want this trial. She wanted the fame, but the notoriety turned against her and she bailed. Of course, we find that her pattern of sexual looseness and mental/emotional instability has resulted in a pregnancy (from a hepatitis c afflicted heroin addict she met in drug rehab).

                        The fact that he "slid in easily" does NOT mean that the bleeding and injuries were a result of his roughness. What kind of backwards logic are you using to make that leap!? What it suggests to me is that she was loose to start with, the kind of loose that comes from having lots of sex with lots of guys.                             Hey 2012, what's up. Sorry I didn't recognize that we've talked about this before, but I think you used to have an avatar so I think that threw me off (one with "veritas," if I'm not mistaken.)

                            Anyway, I understand that Kobe lied to police because he was afraid of his extramarital affairs coming to light, but couldn't he possibly also be afraid of evidence pointing to rape coming to light and avoiding them? For such a recent event, Kobe really had a sketchy memory of what happened. I couldn't believe how much he was cursing at police when they seemed like they were fairly cordial. Of course, I would hope the person who transcribed the tape wouldn't change how the detectives spoke. I also, for the record, think is sucks for Kobe that he was given all assurances that his extra-marital stuff wouldn't come to light, and now everyone is going out of their way to release it. Price you pay for being a celebrity, but at a young age it's tough to now how clean to keep you nose (although not having affairs is a good place to start).

                            I disagree that she consented to all sex when she initiated some activity. Yeah, from that it seemed like she wanted to hook up with Kobe. Yeah, she went into his room late at night trying to get something. But at a certain point, it could easily have changed. Kobe used the term "strangle" when he said police should check with Michelle. Just because she wanted sex doesn't mean she wanted to be strangled during or have rough sex.

                            As for the trauma injuries to which you and marshall refer, I believe the expert opinion was that it was unclear whether they were a result of forced entry and could possibly be a result of consensual sex, not that they were consistent with consensual sex. Slight difference. But if he slid in easily and then got rough enough to cause trauma...that wouldn't be forced entry, just rough sex causing injury which in theory could be consensual. But again, she never consented to rough sex.

                            As for the accuser's mental state and what all of her friends were saying...things become a different story when people have to swear an oath in court or when submitting an affidavit, or being deposed. Young people often exaggerate to get attention. And also, it's hard to take all that stuff at direct face value when it was leaked to the press by the defense team with an attempt to taint the potential jury pool and clear Kobe's name in the court of public opinion. Stuff like that is what made a trial in this case important for Kobe to clear his name. Now, he'll just buy her out of the civil trial and we'll never know truly if she has mental issues that affected her judgment or if she thought clearly and was taken advantage of.

                            Anyway...I said in my post that the transcript makes Kobe a less-than-innocent man. I think it raises legitimate questions on what happened that night and he very well may have raped her. I think what very well may have been the case was that it was consensual at first and then he got aggressive and hurt her, unintentionally. What is unclear is whether she made him aware that he was hurting her, or if she was too scared because this strong 6'8" man was behind her with his hand(s) on her neck. He said in the transcript that they never spoke about the sex, so she never consented to rough sex. I believe that in some states that can be prosecuted as a sex crime (varying levels of criminal sexual contact), but I'm not familiar with Colorado's sexual assault statutes. It's troubling that Kobe can be guilty of a crime without being fully aware that he was hurting her...but then again, if there is no consent, then it's not consensual sex, so it has to be something. That's why it's important if you're going to be rough to actually talk about it. Strangling counts as rough, even if his usual girlie Michelle is cool with it.

                            We also have to realize we've only heard (mostly) Kobe's side through all of this...all of the info leaked is anti-accuser info, this transcript, some DNA stuff, and the charge filed in court (which doesn't have details). If we had the prosecutions side of the story, we all might be less willing to give Kobe a free pass.

                            Ultimately...Kobe is living in a dream world, because whether or not he was guilty of rape, he certainly didn't treat this woman with respect. I'm not giving him a free pass on this. I don't know if he's legally guilty of rape or not, but I do think he hurt a girl changing what was once consensual sex into something else. And without a trial we won't ever know what that something else was and whether she made Kobe aware of what she was feeling. She had every right to be afraid, and perhaps that may be why she didn't speak up forcibly. I know we have talked about race in this before, and, yeah, there's a chance that race could factor into her being more or less scared (and, unfortunately if it went to trial whether a jury could believe she felt threatened, scared and/or attacked). But I think between the accuser and Kobe that race is not the issue...it's gender. It's about men having power because we are stronger than women physically, and Kobe is a physically overwhelming man at 6'8" and a professional athlete.

                            I just realized I've been writing a long time. I don't post to bash Kobe, I just think a lot of people aren't respecting the accuser's perspective. In all likelihood, she was wronged. It's just a question of what level did this wrong rise to.
