Actually...that's not true. There are rules that allow attorneys to be sanctioned for filing frivolous litigation. And we know this case is not frivolous, since it's already passed the motion to dismiss stage and is heading towards trial.

I hope you understand you can find an attorney to take any case to court in this country.Next point there are courts in this country pro business and others anti business.Even if EA loses it will be appealed chances our this case won't even get to the Supreme Court till about the time EA and the NFL exclusive rights are up.2013.
I do agree that it's a case that EA is likely to win, and don't agree with where it focuses on culpability or reasoning, but I also don't agree with the notion that it's completely baseless. It comes down to perspective, who argues their's better, and how the ruling body interprets the applicable laws. It's up for grabs to an extent if the claimant can pursue it to the end. What happens if EA gets socked with a multi-million dollar judgment? Yes, it would be appealed, but it's doubtful that the exclusive license would continue (adding to plaintiffs' damages) while the matter played out through appeal. That's not even taking into account how the NFL would feel about its name being associated with the antitrust judgment leveled against EA.Comment

Ultimately, you may or may not be right. Since you didn't include any analysis, I can't really form an opinion on your logic. Personally, I'm just glad the Pecover judge didn't share your opinion when ruling on EA's motion to dismiss.Comment

This case could have been stopped before it even got started. But since it's heading towards trial, someone including the judge that let this case move forward think that the plaintiff case should at least be heard.Comment

I don't understand why people want EA to win...Ok you like madden....So what? If another company could make an NFL game, than EA would step their game up instead of giving us all of these gimmicks that they barely even work on. Why do you think Pro tak sucks? Why do you think every innovation EA brings to madden sucks? They don't care as much. If somebody was on their back taking their money...You know damn well they'd put more effort into things.Comment

Wishful thinking. There is about a .00000001% chance that EA loses this case. Being in court today is not relevant. Lots of dumb cases go to court every day. Even if a judge was on crack enough to risk their reputation and actually put this through it would get shot down in appeals in an instant.Comment
