          Actually the prosecution doesn't have to prove who pulled the trigger to convict any or all of them of murder. The law considers all of those involved in a murder to be equally culpable regardless of who does the actual killing. If they each testified that the other pulled the trigger all they would be doing is incriminating themselves by admitting to being present during the murder.

            Now just put the murder weapon in his hands at the time of death and you've got something. The jury will be given very specific directions from the judge prior to deliberation, VERY SPECIFIC. I'm not speaking of Hernandez' innocence or guilt, just generalities. From what I've seen read, there is a lot of circumstantial evidence, and any good defense attorney can blow a hole through circumstantial evidence. Which is why I am interested in hearing the "facts of the crime" from the prosecution.

                It all depends on the legal definitions in the state. But there may not be enough to convict of Murder one, which is premeditated and willful (wiki). Since he is being charged with murder one, the prosecution has to prove premeditation and willful intent. He is only charged with murder one, so if the defense can just prove this wasn't premeditated, then by definition he is not guilty of Murder One. Without knowing what the others are charged with it is very hard to say what/how this will play out in court. But Murder One is a hard charge to proove, which is why the state must have some overwhelming evidence, being that they went for the top count and you only get one chance at a conviction.

                Murder two has less of a burden, but also less of a sentence, and usually bail. The prosecution has essentially said this was a willful and planned execution and they believe they have enough evidence to prove that.

                  I think even with the small amount of info known at this point, pre-meditation would be easy to prove...proving he actually pulled the trigger may be slightly different.

                    I agree, on the bold, with what we know. More than the Casey Anthony or Jody Arias I will be watching this trial play out. But there is a saying amoungst lawyers that "jury's are unpredictable" which is why this will be an interesting case.

                        What a crazy story this has been to follow. Just crazy. I don't want to speculate on whether they have enough evidence to convict him or not of everything theyve charged him with, however I'd assume they think they do in order to arrest him, and lay the charges they have. Cant for the life of me figure out what in the heck that dude was thinking. Wow... nothing like throwing away your entire life at such a young age, throwing away the cash, and everything that comes with the NFL lifestyle. Yikes.

                        As for the Pats... I love it. Couldn't have happened to a better team Anything that's a negative for them, is a huge positive for me! lol
