They will lift the ban on launch day. The guy should have never hooked his box up to the internet though.

Its more so about the videos than him going online. If he doesn't film it. He is probably online having a grand time right now.

Because theres still an embargo on the information being released to the public, regardless if he's a member of the media or a random guy. Either way Major Nelson already stated it will 100% not be permanent.

You can't embargo a paying customer. They can claim it's against Eula and keep him from live, but in court, if he wanted to press it that far, it wouldn't hold water. And if the live ban prevented console updates then they would have a mess if they kept the ban. At the end of the day they did the right thing but called it something dumb. The service isn't ready yet no reason it would be an issue to say he can't access live until launch not that he's banned, which has a different connotation in online gaming. The YouTube videos is more of a decision by YouTube and violation of their tos as to why Microsoft could get it removed.

I feel so bad for moonlight. He was such a big supporter of xb1 as well. I hope Microsoft reverses their policy for him. **** ain't right.

I hope he gets some gifts from MS. Despite being banned, he's still insisting everyone will love the console. MS could have handled this better, so they should float him some free games.

Well, they can (the banning and such obviously) but he did nothing wrong. This is just a big company being crap. Sony and MS did the same thing banning those who got GTA V early.

You can easily ban someone from a service not yet meant for public consumption. I don't think this is surprising at all and I'm sure they're well covered in the TOS.

Happy to learn a lot more about the Xbox One last night... so many things not even talked about like the timed achievements makes me wonder what else there is to learn about the platform.

I just saw the list of existing Forza 4 tracks that are NOT in Forza 5 and it made me sad because my favorite track is on the list (Nurburgring, although I liked Fujimi Kaido a lot as well):

Right, but what about all those other users who are online? I'm sure most of them are Microsoft/Xbox employess, but Kotaku just mentioned that Target probably shipped about 150 units. So are they gonna "ban" all those or just people who are posting media? Like I said, this guy did nothing wrong, and I would love to know what copyright his unboxing video violated.

Would love to see some documentation on this because it is 100% false. Embrago are for media members to allow them to receive games and consoles early, inorder to review them, work on guides etc. They also receive their versions gratis. As a paying customer you are under no such embargo EVER. While companies can make copyright claims on your video, they can't pursue legal action against you like they can a member of the media who break an embargo or NDA.

Anyways, I've been on vacation and am getting caught up on some of this XB1 info and while as a gaming system I am more excited for the PS4, I am loving the stuff that I am seeing. I really want to keep the XB1 that I have on order but I have no idea how I am going to convince the wife that we need two next gen systems right at launch weeks before X-mas. Who knows maybe I can find the one parent online willing to pay $1,500 for a PS4 because I really would like to keep my One the more I read about it.

They can do it(banning)....obviously.....but only because the T.O.S. probably has some blanket statement in it regarding a "whenever deemed necessary" option in there.

Very much agree there. But I think it is wrong to ban the guy tho. The best thing for them to is unbanned the console or give the guy anew one. It's wrong to make this guy waste his money for nothing. It ain't right what so ever. But on the other the guy should have known better to go online 2 weeks before it was release. But it happens. MS should be nice enough to unbanned his console once release day comes.
