He's suing for "emotion distress"
According to his lawyer the employees crossed the line when they chased him out of the store.

This is the problem, if it is true. The Autozone employees had the right to defend their business. As soon as they got the gun away from him, the beating should've stopped, if what Buckman says is true (which is very doubtful given his record) then he should be entitled to something after the Autozone employees crossed the line.Buckman claims the men chased him out of the store and continued to beat him. He is suing the auto shop and the men for the injuries he suffered and for emotional distress

he didnt have his gun when he left, right? they kept it?
whos to say he wouldnt be back with another gun for revenge. i think they did the right thing.. whos to even say that he couldve had backup in a car nearby with guns inside. they scared and beat him just enough... plus they were emotionally rialed up and scared. is there any defense for actions out of fear. fear that was caused by the "victim"?Comment

Well the suit can be defended with contributory negligence, which I am not about to spend the better part of an hour explaining, but in summary it is if you did something to contribute to the tort, then your damages can either be mitigated or cancelled out all together. In some states as much as 1% contributory negligence can defeat a suit, in other states it takes 51%, and in others the jury will award a verdict then deduct the part you were contributorily negligent for. Ex., A wins a $100k lawsuit vs. B, the Jury finds the contributory negligence on the part of A was 95%. $100k x .95 = $5k that A would actually receive in damages. I don't know where NY is on this spectrum other than they aren't in the most stringent group (Washington, North Carolina, and maybe Alabama are however).Originally posted by RubenDouglashe didnt have his gun when he left, right? they kept it?

Id go all out and get the big boys involved. most of the workers are there for a reason...they need to be, for financial supportComment
