This is the problem, if it is true. The Autozone employees had the right to defend their business. As soon as they got the gun away from him, the beating should've stopped, if what Buckman says is true (which is very doubtful given his record) then he should be entitled to something after the Autozone employees crossed the line.

I agree with you on this one if what Buckman says is true.

However, instead of chasing him out of the store why didn't the employees hold him there until the police arrived? That would have been the most logical thing to do.

is there any "logic" when youre life is on the line and youre scared.. you do almost anything without thinking just to save your life... now youre getting sued by the guy who almost killed you. I love america

I see what you're saying, but ifthe guy was as subdued as he says he was then you just can't beat him anymore as that makes you know better than him.

For completely frivolous suits I think the rules of Civil Procedure allow for you to sue for attorney's fees, but this is NY and their Rules of CivPro are different and much more complex than any other state, but I'd venture to guess they allow for this recovery as well.

But otherwise this is freaking funny.

No he wont. This wont even see trial. What may happen is Autozone will settle for a small amount (a couple of grand for his medical expenses) and be done with it. The plaintiff's atty would be crazy if he doesnt tell his client to accept that settlement because if this case sees a courtroom it will get tossed.
