ive never been on probation, so i dont know how strict they are with it...but i would think that if it's the FIRST time she has been on probation and the FIRST time she has violated probation, then giving her 45 days in jail is excessive imo. There are ways to punish people without throwing them in jail, especially if they have no prior history. Jail should be the last option, and I dont see how jail was necessary in this case. but it doesnt suprise me that the court would be excessive and try to make an example out of this case. Personally I think this is a perfect case of showing the justice system working fairly, ie justice since she was treated no differently than some John Doe who had done the same thing. And I know of someone who did violate their probation for a rather "minor" thing and had to go to jail so it's not exorbitant or out of line, it's reality.
Oh and they don't need to tell you warnings or treat you with kid gloves just because it's a minor 1st time offense or whatever as you suggest, they do all that when they give you probation. That's just what probation is, a second offense in a short period of time that shows you cannot follow the rules. Har far has Hilton goes,she didn't violate it once. She violated it twice. Which is two more chances than most people get. He should have thrown her in jail. And to be honest he should have held her mother in contempt of court and hauled her in too. Because she seems to think they're above the law.
If anything,they need more judges like this guy out there in California.Comment

She clearly didn't care or take seriously her initial arrest for DUI. She was caught twice driving without a license (the second time at night with her headlights off, probably trying to avoid being noticed, which also proves just how dumb she is) while on probation and failed to enroll in substance abuse classes as mandated by the court. If someone is going to ignore their ruling and think they can just fly by without any real punishment then that's absurd, and the judge's ruling is forcing her to accept some form of punishment for her actions. What is the point of repeatedly taking someone's license away if they're going to just drive anyways? How is fining someone with her bank account going to make her feel any sort of guilt or remorse for what she's done? Really, the only way the judge could punish her was to throw her in jail for a short while. She'll be there for 45 days, and likely she'll be protected and it will hardly seem like prison compared to what the average person gets.Comment
