Big Win for Fantasy Sports Fans

Fantasy baseball leagues can keep using the names and statistics of major league players without licensing agreements.
The Supreme Court on Monday refused to get involved in an ongoing dispute between a fantasy sports business and professional baseball.

Well, only baseball is involved. The NFL realizes that fantasy football has made their league even more lucrative. How many non fantasy fans buy NFL Sunday Ticket?

This is also a big win for text sim games such as OOTP. It means they can publish a roster that contains real player names and ratings.

How is this different from video games then...is it just the likenesses? Couldn't a game put out a roster where they didn't look like the guy but had his name and not require the Player's Association license? I guess I don't see the big difference between OOTP names and Madden or MLB names, you know?

I don't think their "non decision" is as far reaching as that. Although player's stats were not considered MLB's intellectual property because they were "readily available" in the paper and online, a player's ratings and abilities are a different animal.

How is a subjective rating and ability considered to be intellectual property?
