    I agree the crime wasn't egregious and punishment should be commensurate with the harm (which is not insubstantial but not ultra-harmful). Hence, the second part of my above comment re: the disparity of charges and sentencing for those that plea out and those that exercise their 6th amendment rights.

            Legal proceedings take forever. If you've ever had the misfortune of ending up on a jury, it will immediately become apparent why.

                You're either lucky or good...or a bit of both (!).

                It's actually not as easy as people think to get thrown off of a jury during selection/voir dire. You can do it, but unless you get a lenient or careless judge, you have to commit to your bit if you want to get dismissed.

                  I haven't lived in New Mexico since 1999 and have been called for Jury Duty there more times (twice) than I have in PA (once) since I moved to this state.

                    I've been picked every time I've been in the court room, 3 times. I got called for a grand jury, but there was no way I could do that for months. So I said I couldn't do it because I had a doctor appointment out of state and may have needed surgery. It was true, but the likelihood was low.


                    They can't really say anything against medical reasons. Judges do get pissed when you try and bs them but you will probably scare off the lawyers.

                      I've never even gone in for a jury selection thing. Everytime I show up I just sit there for 4-8 hours then go home

                        They have different agreements. She’s going in for 2 months and a year of supervised release, he’s got 5 months and 2 years of supervised release. They probably paid crazy money in legal fees to postpone the inevitable.

                          They definitely can refuse to excuse you for medical reasons, as I personally witnessed first-hand not 8 months ago. But the judge was really a hard-a** in that regard and it sounds like you got a more reasonable judge.

                          You're right, but I do think that it raises some questions about whether prosecutors are intimidating defendants into waiving their 6th amendment rights, which is troubling to say the least. No one is going to care in this case (and it's not even the most egregious example) but they probably should care. The disparity in charges and sentencing between those that plead out and those that wanted to go to trial was/is troubling.

                              Not many questions to be raised, that's the way it is and the way it's been forever, not even news. There's a SCOTUS case from 1977, Bordenkircher v Hayes where a guy committed forgery, for a sentence between 2-10 years. Prosecutor said take a deal and we'll give you 5 years, reject it and I'll charge you under a 3 strikes law and you'll get life. He rejected the deal, was charged under the 3 strikes law, and got life. The Supreme Court decision was it's not unreasonable to charge someone with something they're guilty of...it is of course also the prosecution's job to prove guilt, thus coercive plea bargaining was sanctioned by the highest court in the land.



                              In this specific case I'd say it's a mistake to look at the disparity in charges because Huffman and Loughlin weren't accused of the exact same crime to begin with. Huffman paid 15k to have someone take an SAT test, Loughlin paid 500k to have that whole crew thing staged and paid out bribes to people at the school.
