Okay, I'm looking at this from a logical perspective, which is something most of our country rarely uses for these situations.
Now it seems to me, the only time which anyone would have a case in this, would be if someone bought their 17 year old an M rated game, only to find that it is really suitable for 18 year olds. To me, they might have a case, because they are actually abiding by and accepting the ESRB ratings, and thus show that they expect 17 year old content.
But how does this lady have any case? She bought her 14 year old kid/grandkid a game suitable for those 17+ years old. By doing that, she is pretty much accepting that there will be content not suitable for her kid, and therefor waiving the ESRB ratings. So what if it turns out the game is suitable for 18 year olds, the 14 year old is already seeing content not suitable for him anyway.Comment
