I hope so. There are some things I wished I did differently.
I swear, Massachusetts likes to mess with barBri. Last July they tested on 2 topics that they hadn't tested in 20 years. This year the Contracts question was entirely on a minor entering into a series of contracts.Comment

LOL maybe. We discussed this question afterwards and I think we all had different answers.
Here was the question to the best of my recollection. Age of consent is 18, it is a strict liability crime to have sex with a minor. 15 year old girl asks her 18 year old boyfriend to have sex with her. Guardian then sues boyfriend for the tort of battery.
Will he prevail?
A) No, (totally wrong answer)
B) No, because she consented
C) Yes, because Boyfriend is 18
D) Yes, because the statute was designed to protect Girl.
I said C. I remembered when we had the BarBri class the GW Torts prof said children can only consent to age appropriate activities, which would include sex if there is an applicable statute. So by that logic she couldn't consent. D seemed wrong because that is part of the test for Negligence Per Se, and this was an intentional tort, so D wouldn't seem to apply. I can't remember what A was but it was just completely wrong. C seems to be the only logical answer if I apply what I learned in BarBri.Comment

I would think it's C. If it's B, there's no point to it being a strict liability statute. This answer coming from someone who is going to have to learn all this stuff in June/July.Comment

Yeah I was heavily leaning towards B at first, but then that one thing from Torts popped back into my mind and I couldn't justify C. Honestly with a question like that, I wouldn't be surprised if both B and C end up being answers that get credit.Comment
