From listening to the whole thing it seems to me that Horn had his mind set on shooting these two guys from the second he saw them break into his neighbor's home.Comment

I don't really feel bad for these two, but I'll throw out a situation that's kind of similar but not the same:
If you owned a gas station and a car pulled away without paying for their gas would you shoot to kill?
I know I'm stretching it but that would stop the thing before it started.Comment

'Castle Doctrine'What made the case so controversial is that, even though Horn seemed to mistakenly evoke the recently passed "Castle Doctrine" in a 911 recording, Horn's own life and property were never in jeopardy until he decided to disregard a dispatcher's pleadings to stay inside his home and took it upon himself - and his 12-gauge shotgun - to stop the bad guys before they "get away with it." Police said Horn shot both burglars in the back, although a plainclothes officer who had arrived in time to witness the shooting said one of the burglars appeared to run toward Horn before angling away.
But even if Horn hadn't created a situation where he needed to defend himself, a section of the Penal Code dealing with protection of a neighbor's property basically grants Horn the right to shoot if he thought the bad guys were getting away with it.
Antiquated statute
According to the statute, deadly force is justified if the shooter "reasonably believes" it's immediately necessary to stop the burglars from escaping with the stolen property. It's also justified if the shooter "reasonably believes" that "the land or property cannot be protected or recovered by any other means."

Bottomline, know your state laws. you can be robbing one playstation or some credit cards, its a shoot to kill without question society in texas as far as robberies are concerned. blame the laws if anything, for letting this man get away with what he did.

Bottom line for me is that while I do believe that morally it was wrong to shoot to kill, legally he wasn't in the wrong. As for the criminals: karma's a bitch, isn't it?Comment

I'm about to move to Texas just so I don't have to back myself into a corner in order to protect myself. most states even if they are in your house, you cant do anything unless there is no other way. Hell some states have allowed a home owner to be sued because the burglar injured himself during the robbery. Personally I feel once you enter my house illegally my life is already in danger whether you are armed or not. Whether your in my room or not. Suppose if I come down from my bedroom and see you ransacking my living room, and I got a chance to take a shot without you noticing me, I want to take that shot, minimal risk of me or my family getting hurt. I gotta agree with Trevytrev11 and the others who said the guy should be punished.
One of my best friends has a line that he LOVES to use in situations like this: It's a Slippery Slope.
Where do you draw the line? If a person has the right to shoot someone who commits a crime, how do you say what crime is worthy of this vigilant punishment? The 15 year old kid who just shoplifted from a department store? The 80-year-old man who just ran a red light (He's CERTAINLY putting the lives of others in danger)?
And I feel the argument that they are illegal immigrants and low-lifes and deserve it is silly. Did he know of their identities? Absolutely not. He just knew they were robbing the neighbor's house.
Basically, what this comes down to is this question:
