At an officer discretion, a reporter can be asked to stop if his actions or presence is making the situation worse or dangerous.

Reporter Guy was adding to the rubber neck factor and by his location suggesting that it was okay to pull over (to the left hand side even) and watch. No civil liberties where at stake, just a cop telling a reporter to move.
