    Apartment Lease Question

    I moved into my apartment August 1, 2010. Since I've been living here 3 residents cars have been broken into, and last night a resident was robbed as he was walking from his car to the apartment entrance.

    I have a one year lease. I do not feel safe living here, primarily because of my wife. She gets home late from work a few days out of the week and it's obvious people are targeting this apartment, and I know something will happen again.

    So can I possibly break my lease due to whats going on? I mean this is ridiculous. I've never had to break a lease before so I'm not sure what the penalties are or what to do. Thanks.

    That's dicey. Legally, they have no reason to let you out of your lease. Also, nothing has happened to you personally. You can ask to see what kind of penalty there is. Usually ain't cheap.

    Actually had my apartment broken into 3 weeks after renewing the lease. They offered to let us switch to a different apt within the complex but that was it. We ended up just staying since moving everything would have been a pain and not solved the problem. We moved out once the lease was over.

      You are SOL.

      You could find somebody to sublease the apartment, but then you would open up an entire plethora of questions about that.

        MassNole could probably fill you in on this topic. I would think a good lawyer can get you out of the lease w/o a penalty due to the crime outbreak at the complex.

          I figured I was probably SOL. This is just a scary situation because the robbery happened at 8:30 last night, my wife got home at 8:10. Otherwise it is a decent apartment complex, the staff is very nice.

            Nothing to do with the lease really, I dont know much about that stuff. But I would have you and your wife start carrying pepper spray or something.

              What is the lighting situation in the parking lot and entrance areas? You could try and build a case around that by requesting that it be improved if there are dark areas. The parking lot at my apartment building is very well-lit. That didn't stop someone from smashing in my window and trying to steal my stereo, though, lol.

              For the time being, the best thing for your wife to do is to take self-defense classes and carry mace and a whistle on her key chain. You should be able to find a self-defense class available for free through a community center or the local police. That's scary stuff.

                That's messed up. How well lit an area is, is only a small part of the problem. Because if people know that most people in that area go to bed early or know after a certain time most people don't leave their apartments, they will hit it.

                And being they constantly hitting it tells me they cased that place out for a while or use to live in that area before and know how it is. Probably know what the police response time is too for that area.

                  Honestly I don't think you can get out of the lease, but I'm no expert.

                  Here are my suggestions:

                  Call the local police department and ask for zone checks in your apartment complex. Let them know of the recent criminal activity and the fear it has generated.

                  Complain about crime to the apartment complex and get your neighbors to do it as well. Get them to dish out some money for security. As I type this I just saw one of the security cars drive by! Must be a sign haha

                    Thanks for your advice guys. Yeah, the apartment isn't well-lit at all and there are a few trees surrounding the area, blocking the apartment entrance from the street. The apartment managers said they were given permission to cut the trees down, which will increase visibility but probably won't do much, because the street is a dead-end and there isn't a lot of traffic.

                    I've taken self-defense classes but my wife hasn't. She has mase in her purse, but I'm still obviously worried about her and she is nervous.

                    One thing I noticed is there aren't any cameras at the entrance to my apartment, which is where the robbery occured. The managers at my apartment promised more police patrols in the area.

                    I think it's the same person/people doing the robberies. The apartment is in a very quiet area, where there isn't a lot going on around it. There are a lot of senior citizens who live there (me and my wife always say we live at a retirement home) so it is a easy target for crime.

                      For now you need to go out and get her pepper spray that fits on her keychain and get one that is more powerful and will fit in her purse. Tell her to have in IN HER HAND as she gets out of the car. Hell get her a taser too.

                        Yeah she has some already in her purse, but I don't think it is too powerful. I'm going to go online and do some research.

                        When she gets home, I'm just going to meet her at her car and walk in with her whenever I'm at home.

                          Find out the gun laws in your area and see whether or not it is illegal to walk out to her car with a shotgun

                            Hell you better check out the pepper spray and mace laws too. It isn't legal to carry those things in all cities and towns. I actually had a friend get arrested for spraying the guy who tried to mug her.

                            Not only that but that S.O.B family sued HER for assault and endangerment because the guy had asthma. Being it was illegal to carry mace or pepper spray in the suburb she lived in, she was charged with carrying an illegal weapon and concealment.
